Dispatch issued by the Ouvidor do Cível da Relação da Baía, João de Góis de Araújo, approving the motion moved by Bento Teixeira, depositary of the chapel founded by António Cordeiro, against the abbot of São Bento's monastery, regarding the judicial dispute between them over a land. The motion was approved because the appellant had successfully proved that there was a cause in the Juízo das Capelas regarding the succession of the entail between him, as prosecutor of his mother Margarida Vieira, sister-in-law of the institutor, and Francisco Lobo, prosecutor of a cousin of the institutor. Therefore the Ouvidor accepted that Bento Teixeira could not be summoned once the cause of the succession was still running and had religious fundaments, and he, as depositary, could not dispose of the entailed assets.
