Codicil

Codicil by which Martinho Lopes de Ataíde confirmed his will, bequeathing all his estate to Isabel do Couto, his daughter. He forbade his daughter and her descendants of leaving the entail's administration to Esperança Fernandes and her successors. The testator determined that, instead of what he had declared in his will, if his daughter left no offspring, the entail would be administrated by his closest and poorest relative. Followed by an approval deed issued on 1604-09-28.

Will chart by which Martinho Lopes de Ataíde established a chapel, entailing to it all his remaining assets and appointing his daughter, Isabel do Couto, to become its first administrator. She and her successors had to support the celebration of a daily perpetual mass for the institutor's soul in the chapel of Nossa Senhora of the convent of S. Domingos of Elvas, where his body would be buried. She was obligated to give 200 000 réis to her brother, Manuel, if he ever returned to Elvas. The entail should be transmitted to Isabel's descendants, but if she left no heirs it would be administrated by a priest who would celebrate the annual masses. If the priest did not belong to the institutor's family, the entail would be administrated by a clergyman elected by the Provedor de Elvas. Followed by an approval deed issued on 1603-11-22.
