Court sentence

Court sentence, issued by António Corvinel da Gama, corregedor, judging a civil process between D. António Alcáçova, plaintiff, against Gonçalo de Alcáçova, defendant, concerning the administration of the entail instituted by Rui de Carvalho. The opponents were D. Maria de Carvalho, D. Francisco de Azevedo, her husband, José de Lima and Bento de Carvalho.
The sentence acquits the defendant, recognizing him as the legitimate administrator of the entail, as he is the closest relative of the last administrator and descendant of the founder through male line. Condemns the plaintiff to return to the defendant the possession of the assets of the entail.
The documentary set contains moreover three acórdãos em relação, dated 1661-02-04, 1668-07-17 and 1674-08-11.

Entail foundation deed

Entail foundation deed by which Rui de Carvalho, fidalgo da Casa do Rei e do seu Conselho, establishes an entail with several properties and public debt instruments. He bequeaths it to his eldest son, Bernardo de Carvalho, with the obligation of a daily mass for his soul in the convent of S. Francisco of Lisboa, where he shall be buried. Bernardo de Carvalho is present and accepts it.

Royal sentence

Royal sentence against D. Inês de Meneses, widow of Bernardo de Carvalho and tutor of her minor son, Rui de Carvalho de Albuquerque, administrator of the entail established by his grandfather, Rui de Carvalho. D. Inês de Meneses had started a conflict against D. Joana de Távora, declaring that her husband had improperly sold her a rent in an estate in Grândola which belonged to the entail of her son. It was proven, however, that this rent wasn't part of the entail, as it hadn't been included in the partitions made after the institutor's death, nor in the legitime of his son, Bernardo de Carvalho. Thus, the sale had been valid and D. Inês de Meneses was ordered to pay the charges.
Followed by deed of sale by which Bernardo de Carvalho sold the rent to D. Joana de Távora, declaring it free of any obligations or entail.

Will (extract) by which Gonçalo Vaz de Carvalho, son of Rui de Carvalho, bequeaths his brother, Bernardo Carvalho, two public debt instruments and the revenue of his houses in Lisboa. Bernardo Carvalho shall add these assets to the entail established by their father, of which he is the administrator, with the obligation of two daily masses over the tomb of their parents, in the convent of S. Francisco of Lisboa.
