Acórdão em relação

Acórdão em relação, judging a civil process between João Cabral, plaintiff, assisted by the procurador da Coroa, against Diogo Soares Botelho, defendant, on the denunciation of the chapel instituted by Catarina Botelho.
The sentence demonstrates how the institution went against ordination as it handed over the administration of profane assers to ecclesiastics. Consequently, it declares the chapel vacant for the Crown.

Codicil

Codicil of Catarina Botelho, changing some testamentary dispositions. In relation to the first chapel that she had established, which she had left to the Misericórdia of Elvas, after the death of Belchior Botelho, first administrator, she now decides that, after that one's death, it should remain with her closest relative. The administrator should be a priest or be able to be ordained, with Belchior Botelho being responsible for appointing the successor who fulfilled the requirements. There being no relatives, she would then be at the Misericórdia of Elvas.
It follows the respective approval deed (dated 1605-09-30).

The desembargadores do Paço should issue the respective administration letter, after presentation of this warrant and the sentence proving its vacancy to the Crown.

Manuel Gomes was appointed administrator by priest Belchior Botelho, his uncle, but being ill, he did not consider himself to be ordained a priest, so he donates the administration to a nephew who could do it.
