Acórdão do Desembargo that revokes a previous sentence from Corregedor do Cível da Corte, condemning the defendant to relinquish to the Diogo Soares da Veiga do Avelar e Taveira, plaintiff and administrator of the entail of Isabel de Avelar, the lease of a farmstead (quinta), with its income generated since the contested lawsuit. The lease was included in the entail by the institutor, who appointed the administrators to succeed in the lease.

Court sentence (transcription)

Court sentence judging that Diogo Soares da Veiga do Avelar e Taveira, plaintiff and administrator of entail of Isabel de Avelar, does not have action to claim the ownership of the lease of a non-identified farmstead (quinta), belonging to the monastery of Santa Clara of Santarém, to the Provedor and Irmãos of Misericórdia of Lisbon, defendants, who legally own the lease and are absolved. The successors of the entail only owned the lease for three lifes.

Entail foundation deed

Entail foundation deed by which Isabel de Avelar, wife of Henrique Nunes de Leão, establishes an entail with all of her properties. She appoints her grandson, Jorge Nunes de Leão, legitimized son of her deceased son, Martinho Gonçalves, as her universal heir. He shall order a daily mass in the convent of S. Francisco de Xabregas, to be paid with revenue from her houses in Lisboa. His sucessors shall have the surname and coat of arms of the Leão family. If his lineage is extinguished, the entail shall pass to the lineage of Isabel do Avelar's nephew, João de Avelar or to the lineage of João Taveira, her great-nephew, who shall keep the Avelar surname.

Will chart by which Isabel de Avelar expresses her wish to be buried in the convent of S. Francisco de Xabregas with an obligation of a daily mass for her soul and the soul of her husband, Henrique Nunes de Leão. She confirms the foundation of her entail, which she bequeaths to her minor grandson Jorge Nunes de Leão. She also appoints him in several leases she possesses and establishes how he must be raised, appointing her daughters, nuns in the convent of Santa Clara de Santarém, as his tutors.
