Acórdão

Acórdão nullifying the court sentence issued by the Provedor das Capelas that ended the legal action opposing the Promotor das Capelas to António de Saldanha, administrator of Pedro de Moura and Mécia de Abreu's entail. The court declared that D. Mécia de Abreu acted against the law by entailing houses in Rua das Arcas, which were not included in the third part of her assets, to the chapel established in S. João da Praça. By doing so, she altered clauses of the entail foundation deed. The defendant was subsequently absolved.

Entail foundation deed by which D. Pedro de Moura and his wife, D. Mécia de Abreu, establish an entail with the third part of their assets, which comprises houses in Lisboa and lands located on the outskirts of Azambuja, designating D. Manuel de Moura, their son, to administrate it. After his death, the entail would be transmitted to his eldest male son, D. Jerónimo de Moura. Its future administrators are obligated to support the celebration of an annual mass for the institutor's souls in the convent of Nossa Senhora das Virtudes of Azambuja.

Subrogation warrant to João de Saldanha de Albuquerque, administrator of the entail of D. Pedro de Moura and D. Mécia, his wife, allowing him to sell some old houses, in S. João da Praça, and to exchange them for another houses, in Junqueira, belonging to the entail of Junqueira, founded by Aires de Saldanha and D. Joana de Albuquerque, his wife, also administrated by him. The houses of S. João da Praça need continuous repairs, in which it is spent a large amount of the income. Besides that, its income is bounded to a revenue of 1 conto 972.000 réis, payed as an interest to Luís de Saldanha de Albuquerque, brother of João de Saldanha de Albuquerque and previous administrator.

Will (extract) by which D. Pedro de Moura designates his wife to be the executor of his will, to inherit the third part of his assets and to administrate it only during her lifetime.

Will (extract) by which D. Mécia de Abreu declares that she had made an agreement with her brother-in-law, D. António Gonçalves da Câmara, who committed himself to give her or her descendants 30 000 réis, each year, as long as he lived, and to bequeath her, after his death, part of the patrimony left by her sister. She orders her successors, future administrator of the entail established by her and her late husband, D. Pedro de Moura, to use those assets to support the celebration of a daily perpetual mass in the church of S. João da Praça of Lisboa, where her body and her husband's remains would be buried. While that patrimony could not be employed in that manner, the revenues of her houses located on Rua das Arcas would fund that pious obligation.
The testator also demands each one of the future administrators of her entail to add to it part of their assets.
