Acórdão (transcription)

Acórdão do Desembargo partially confirming and partially revoking the previous sentence. Besides the assets belonging to the available portion of António Gomes Angel, it judges the assets belonging to the reserved portions of his daughters, D. Maria Angel and D. Graça Angel, and the assets entailed by his wife, Joana Jerónima, as a dowry to their daughter, D. Maria Angel, as entailed, because the parentes can impose conditions on their children's reserved portions, when they bequeath them other equivalent assets and they approve. D. Maria Angel, defendant, can not dispose of the entailed assets as free and, after her death, she will be succeeded by a relative of the institutors.

Court sentence judging only the assets of the available portion of António Gomes Angel as entailed, since the institutor could not impose any condition and entail on the reserved portion of his daughters, D. Maria Angel, plaintiff, and D. Graça Angel. All the other assets, included those entailed by Joana Jerónima, wife of António Gomes Angel, as a dowry to D. Maria Angel, her daughter, are judged as free.

Entail foundation deed

Entail foundation deed by which D. Joana Jerónima, widow of António Gomes Angel, promised to give a dowry of 74 000 cruzados for the marriage between her daughter, D. Maria Angel, and D. Luís Coutinho. The dowry would be paid with a public debt instrument of 100 000 réis, a pension of 187 500 réis, her famstead in Lumiar, her houses in Lisboa and other properties such as an estate ("herdade da Cajola"). With these assets, D. Joana Jerónima established an entail, determining that it should be administrated according to the rules declared by her late husband in the institution of his entail. The institutor's father, Diogo Rodrigues de Vera, and D. Graça Angel, D. Joana's daughter, gave their consent to this deed.

Letter of attorney by which D. Luís Coutinho gave power to João Gomes Castanho to accept on his behalf the dowry deed made by Joana Jerónima, mother of D. Maria, his bride.

Will

Will of António Gomes Angel by which he established two entails with the third part of his assets, leaving them to his daughters, D. Maria and D. Graça. He asked the executors of the will to guarantee that both of them married according with their status, as soon as possible. The testator determined that his body had to be buried in the church of S. Cristóvão of Lisboa.
