Court proceedings (partial)

Côrte-Real, Manuel de Sousa da Silva (flor.1665)

Court sentence

Court sentence determining that Manuel de Sousa da Silva Côrte-Real was the rightful successor of the entail instituted by Pedro de Eça and Maria da Silva, despite the claim made by the convent of Santa Clara of Lisboa. The convent argued that the entail had to be administrated by one of its nuns, D. Antónia de Eça Côrte-Real e Mendonça, who was the sister of its last administrator, D. Luísa de Eça. However, since one of the clauses of the institution forced the administrators to attach the third part of their assets to the entail, and neither the convent or D. Antónia could fulfil those obligations, it had to be delivered to Manuel Côrte-Real. He was a descendant of D. Garcia de Eça, grandfather of the institutor, and the closest male relative to the entail's last administrators, D. Diogo de Eça and D. Luísa de Eça.

Court sentence

Court sentence condemning the defendant, Pedro de Mendonça Côrte-Real, to return a property ("herdade da Latada de Baixo") which was attached to Pedro de Eça and Maria da Silva's entail to the plaintiff, Marquês de Montebelo, who administrated it. The legal dispute started after Pedro de Mendonça Côrte-Real refused to give back that property, alleging that it belonged to the entail he administrated ("morgado dos Mendonças").

Montebelo, Marquês de (flor.1679-1687)

Court sentence (transcription)

Court sentence (transcription) condemning Cristóvão de Almada, defendant, to separate the third part of the available portion of the assets of his wife, D. Luísa de Eça e Mendonça, to annex it to the entail of Pedro de Eça, because she had not annexed her available portion while she was administering it. The entail was currently administrated by the plaintiffs, D. Joana Francisca de Montebelo and the marquês de Montebelo, her husband. It also condemns him to pay the income generated since the undue occupation until its return, and absolves him from annexing the third part of the available portion of his son, Rodrigo Luís de Almada, because he died too early and did not administer the entail. Regarding the entail of Cortes Reais, it reserves to Pedro Mendonça Côrte-Real, opponent, the right to request his part in the annexation of the third part of the available portion to the entail of Pedro de Eça.
