Will (extract)

Will (extract) by which Diogo Mendes Guterres establishes an entail, incorporating in it houses in Rua das Pedras Negras, Lisboa, lands (casal) in Oeiras and the legitimates which he had inherited from his father, Gomes Dias Guterres, and grandfather, Heitor Mendes de Brito. He appoints his son, Luís Mendes, to be its first administrator and asks the executors of his will to buy a chapel in the convent of S. Bento de Xabregas, where he should be buried and there must be celebrated annual masses for his soul. If the convent does not allow that, the executors are free to make a contract with any available church.

It was issued at the order of the Provedor das Capelas, Luís Martins Baião. Contains copies of two court sentences issued on 1669-06-18 and 1669-06-27.

Declaration by which Jorge Antunes and Domingos João, mestres pedreiros, declare that they had contracted with Nuno Dias de Castro to make the grave of Diogo Mendes Guterres in the church of S. Nicolau de Lisboa for 47 000 réis, being bound to finish it until the end of April of 1647. Followed by various receipts of payments made to them until 1647-02-17.

Court sentence attesting the entailment of a public debt instrument of 99 567 réis in Almoxarifado da Guarda, houses in Rua das Pedras Negras in Lisboa, lands (casal) in Oeiras and 3 rents (foros) to Diogo Mendes Guterres' chapel. The judge ordered the making of a tombo of the assets which belonged to that entail.

Codicil

Codicil by which Diogo Mendes Guterres orders that his remains should be buried in the convent of S. Elói of Lisboa until the executors of his will buy a chapel in the convent of S. Bento de Xabregas, where the administrators of the entail must guarantee the celebration of a daily mass for his soul. Followed by notes made by the testator in 1641-07-11, which were authenticated by a notary in 1641-07-15.

Apostille transmitting an entailed public debt instrument worth 79.637 réis to Miguel Cabral de Quadros, due to the death of his mother, Ana Mendes Guterres, last administrator of the entail.

Agreement deed

Agreement deed between Nuno Dias de Castro, mercador, executor of Diogo Mendes Guterres' will, and the brotherhood of Santíssimo Sacramento of the church of S. Nicolau of Lisboa, by which its members donate a chapel in that church to the former, which would contain the remains of Diogo Mendes Guterres and his descendants. In exchange for that, the executor gives 180 000 réis to them, which would pay for the reconstruction of the main chapel. This donation is made under the condition that the future administrators of the chapel should allow it to be used by the brotherhoods of S. Paulo and the menino perdido, preserving the statue of that saint and promising not to put railings around it. Contains copies of an extract of the institutor's will and an extract of his codicil. Followed by a letter of possession issued on 1645-10-13.
