Acórdão em Relação (transcription)

Acórdão em Relação from Desembargo partially confirming the previous sentence and partially revoking it. It judges that the estate from the litigation belong to the entail founded by D. Filipa de Sequeira in her will, in which she appointed doutor Luís Mendes Barreto, father of D. Isabel Barreto, as her successor, so the plaintiffs, strange to the founder and first administrator, are not the properties' rightful owners.

Court sentence absolving Doutor Gregório Mascarenhas Homem and his wife, defendants, from the request, made by the plaintiffs, Sebastião da Cunha da Fonseca and D. Beatriz da Câmara, his wife, of the entail and chapel of D. Filipa de Sequeira, its estate and the available portions of Doutor Luís Mendes Barreto, first administrator, and the late D. Sebastiana da Câmara, his niece, who used to be married to the defendant. The plaintiffs failed to prove their family relationship with the institutor, while the defendants quoted the annexation and the entail succession clause stated by the institutor.

Court sentence judging a litigation between José Gomes da Silva, plaintiff, and D. Isabel Barreto, defendant, about the ownership of the estate of André de Sousa Chichorro and his wife, D. Filipa de Sequeira. It condemns the defendant to relinquish the properties, which she claims that belong to the entail of André de Sousa Chichorro and his wife, to the author, because they are not entailed, but they are from an extincted temporal fideicomisso.

Court sentence judging that the farmstead (quinta) claimed by the defendant, not named, as belonging to the entail of D. Filipa de Sequeira is not entailed and is tributary to Ordem de Cristo. It condemns the defendants to relinquish to the plaintiffs, not named, the farmstead, with its income generated since the undue occupation.

Will chart by which D. Filipa de Sequeira, wife of André de Sousa Chichorro, expresses her wish to be buried in the monastery of Santíssima Trindade, where her father, João Mendes Botelho, is buried. She appoints her husband as her heir and executor, with the obligation of establishing weekly and annual masses for her soul in her burial place, to which he should entail a public debt instrument in the Alfândega of Lisboa. If his husband frees the chancel of the convent of S. Francisco de Alenquer, where he has a family tomb, her bones can be transferred to that place. She bequeaths all her properties, including houses in Lisboa, her quinta da Granja, casais in Odivelas and another public debt instrument, to her husband, as an entail. After his death, they shall pass to her nephew, Luís Mendes Barreto, who must marry D. Leonor de Sá, daughter of André de Sousa Chichorro. If this marriage doesn't take place, the entail shall be inherited by D. Maria, sister of Luís Mendes Barreto, who must marry Jerónimo de Sousa, eldest son of André de Sousa Chichorro. It shall then pass to their descendants.
D. Filipa de Sequeira also revokes her part in the will of her first husband, Francisco da Costa, except the clause by which she gives 10 000 cruzados to her nephew, who is in India, if he marries Francisco da Costa's niece. This money shall be entailed to Francisco da Costa's property, but only if the marriage takes place.
Followed by declaration, dated 1605-06-04, clarifying other donations by the institutor, approval deed and opening deed of the will, dated 1605-06-12.
