Bond

Bond made between D. Manuel de Ataíde, his minor son D. João de Ataíde e Sousa, his minor daughter Ângela de Vilhena, and Francisco Correia, his wife Ana da Silva, and their minor sons António Correia and Maria da Silva, by which all minors sons and daughters of Manuel de Ataíde and Francisco Correia promised under oath that they and their descendants agreed with the conditions established in a previous composition deed made between D. Manuel de Ataíde, his deceased wife D. Maria de Noronha and Francisco Correia and his wife Ana da Silva, that settled a judicial demand they had for over 27 years regarding the administration of the entail founded by Rodrigo Afonso de Atouguia. By this bond, the minor sons and daughters of both parts involved agreed and promised to never change or appeal for the alteration of any clauses of the contract, resigning all their rights of appel, regardless of the Ordenações do Reino, book 3, title 83, and regardless of the death of any of the parts involved. They also compromised to submit this bond to be confirmed by the king who would validate it through the interposition of the clause of his "absoule power, self motu, certain science and perpetual silence". D. Manuel de Ataíde and his minor sons, regarding the cause of the entail founded by Rodrigo Afonso de Atouguia. The sentence mentions explicitly that they have already the king's permission to sign and make the oaths as if they had 25 years old. The magistrate also recognize the licenciado Sebastião Fernandes as attorney of António Correia and Maria da Silva.

By this agreement, Francisco Correia payed 14.000 cruzados to D. Manuel de Ataíde in order to make him and all his sons and successors resign to his right of appel and any other claims regarding the administration of the entail. The sentence was published in Lisbon in 1602-02-27.
