Will

Will by which Rui Ferreira Furtado appointed his nephew, Duarte Pacheco Pereira, who was in Índia at that moment, to administrate the entail established by his father, Francisco Ferreira Furtado. He asked him to transfer his grandmother's remains from the church of S. Pedro of Fajozes to the church of Santa Maria of Galegos. The testator's body would be buried in the hermitage of S. António, where his father lied. Followed by an approval deed issued on 1618-12-19.

Will by which Bento Mendes Mexia expresses his wish to be buried in the church of Santa Maria Madalena de Olivença. He establishes an entail with the remaining part of his properties, with an obligation of 150 annual masses for his soul and the souls of his children João Mendes Mexia and Beatriz Mendes Mexia. He bequeaths it to his wife, Maria Mendes Gaga, during her lifetime, under the condition that she helps support their daughter-in-law, Beatriz Lobo da Gama. The entail will pass to her, after his wife's death, and afterwards to their nephew, also called João Mendes Mexia, and to his son Bento, Bento's godson. If his godson doesn't have successors, the entail shall pass to Álvaro Mendes Mexia, great-nephew of the institutor, son of his niece Inês Mendes. He annexes 25 000 réis of his third part to the entail established by his father, João Mendes Valentim, as had been agreed with his brother, Manuel Mendes.

After her death, the entail shall pass to their eldest son, José Mexia, and to his descendants, or to his siblings. Will by which Diogo de Noronha, who is embarking to Brasil, establishes the succession of his island of São João, which he inherited from his father. He declares that if his heirs die before him, it shall pass to his cousin, Duarte de Noronha, son of his uncle Lopo de Noronha. He bequeaths properties to his wife, Aldonça de Mendonça, and lists his business and debts.

Will by which Duarte de Noronha expresses his wish to be buried in the monastery of Nossa Senhora do Carmo of Lisboa, near his wife, in the family chapel which his son, Pedro de Noronha, is contracted to build in that convent. He orders him to finish the work and to acquire a public debt instrument to give to the convent to fulfil the obligations of the chapel. This instrument shall be bought with his own revenue and with the revenue which had belonged to his other son, Lopo de Noronha, who was deceased. He requests his son to establish masses for his and his relatives' souls and bequeaths him a third of his properties to employ in the ornamentation of the chapel, designating him as administrator.

BENS DO VÍNCULO: todos os seus bens móveis e de raiz, não especificados no título de instituição, fazenda que nunca se partiria, ou alienaria e apresentar-se-ia sempre beneficiada «porque a faz em morgado» (I vol., f. 40 v.º). Quitações e contas iniciais insertas no primeiro volume dos autos, mencionam uma horta de Pedro Gomes de Castro, sita ao pé da árvore na vila de Machico, aforada ao tanoeiro Pedro Martins, razão pela qual se identifica, por diversas vezes, este primeiro volume como sendo da capela do dito Pedro Gomes de Castro. Uma nota do escrivão dos Resíduos (I vol., f. 41 v.º), refere que José de Sousa do Moinho da Serra e João José Lomelino informaram que a horta constante do termo de sequestro apenso é a que se trata nestes autos (auto de sequestro, feito em 1785-04-26, I vol., f. 43 v.º, nas novidades de uma horta terra de inhame sita na rua da Árvore, de que era então senhoria D. Lourença).
SUCESSÃO: nomeia os sobrinhos Fernão Teixeira de Carvalho e mulher Guiomar de Freitas, seus herdeiros universais, que usufruiriam dos seus bens, e por sua morte ficaria à filha destes, D. Ana, a quem dota os bens para seu casamento; suceder-lhe-ia o filho ou filha primogénito; não tendo esta filhos, tornaria ao herdeiro varão mais chegado da geração dos Teixeiras «e se chamara Teixeira», não havendo macho seria fêmea. D. Ana casaria mais tarde com Pedro Gomes de Castro.

Will by which Beatriz Drummond established an entail, incorporating some assets in order to fulfil the pious charges in the Convent of São Francisco do Funchal. She designated António Mendes to be its first administrator. She also designated António Mendes to be the administrator of the chapel established by her husband Sebastião Teixeira de Vasconcelos. After his death, it should succeed his niece Mariana.

Will of Pedro de Brito bequeathing his available portion to his daughter, D. Joana Cabral with the pious obligation of five prayed masses, in the church of Nossa Senhora da Luz, in Ponta do Sol, in Madeira island. After the death of D. Joana, the available portion will be bequeathed to her son, D. Afonso.
Followed by a termo, dated from 1586-12-02, in which the notary describes that the testator presented him his will, requesting him to present it after his death. The testator also states that he has his will as valuable, although it was not approved, because there is not a notary to approve it.

Will made by Maria Rodovalho in which she ordered, among several other dispositions, the foundation of two entails. The first entail should have a perpetual obligation of one mass celebrated every year, in the day of N. Sra da Assunção, on her mother's grave in the monastery of S. Francisco, where her body should be buried. To administrate this entail she ordered the executor of her will to appoint a female relative that should also appoint a female successor after her death, so that the entail was always administrated by woman. The second entail had a perpetual obligation of one mass celebrated every week and she appointed her son Francisco Correia to administrate it during his life, and after his death the succession should continue on the eldest male heir, preferably.

Will of Pedro de Sousa Alcoforado, founding an entail with masses in the church of Nossa Senhora de Sobretâmega. The first administrator should be his natural son, Manuel de Sousa, who should pass the administration to his cousin António de Sousa after having obtained a position with an annual pension of at least 100.000 reis.

Will by which Nuno Martins da Silveira, cavaleiro, rico homem do concelho, escrivão da puridade do rei and vedor-mor das obras das comarcas da Estremadura e Entre Tejo e Guadiana, and his wife Leonor Gonçalves de Abreu, declared that they were each others' last will executors, and also nominated their sons Diogo da Silveira and Fernão da Silveira for this charge. Nuno Martins da Silveira asked to be buried in the chapel of Salvador, in Évora, and ordered the celebration of daily masses for their souls. They contracted to give to the priests of the Monastery of São Domingos some of their rents, textiles to dress the chaplains and oil for the candles. They also wanted to incorporate into this chapel some houses located in Castelo Velho, the "devesa" of Silveira, on the outskirts of Redondo, and a "herdade" called "Meada".

Will by which Nuno Martins da Silveira declared that he wanted to be buried in the Church of Góis, where his deceased wife Filipa de Vilhena was buried. He ordered to build a chapel, asking his son Luís da Silveira to use the rents he would inherit by his death and to order the celebration of masses in this church. The institutor wanted to incorporate into this entail his farm of Currelos and some houses in Lisboa. He also declared that some assets in Olivença and Ilha das Flores, that belonged to his wife's third, should be inherit by his son Luís da Silveira. The institutor was also obligated to incorporate the fourth part of his third into the "Morgado de Évora", founded by his grandfather Nuno Martins da Silveira.

Will by which Luís da Silveira ordered to build a chapel in the Church of Góis, to be buried with his wife D. Beatriz. If the chapel would not be finish by his death, he wanted his heir Diogo da Silveira to finish it using the his rents. He mentioned the existence in this church of another chapel of his great-great-grandfather Gomes Martins de Lemos. He declared that he was obligated to incorporate the fourth part of his third into the "Morgado de Évora" and the chapel of Salvador, in the Monastery of São Domingos. He wanted to incorporate into this entail some houses in Évora and Lisboa, the farm of Currelos and some assets near to the farm of Graciosa. Followed by an approval deed dated 1529-03-22.

She declares that her body should be buried inside that monastery, next to the remains of João Fernandes and of their children.

After her death, the entail should be inherited by their eldest son. The testator declares that his body should be interred in that church, inside his parent's grave.

Guiomar de Eça, widow of Lopo Vaz de Sampaio, governador da Índia, expresses her wish to be buried in the Capela dos Reis Magos of the monastery of Santíssima Trindade of Lisboa, which she had established with her husband in a previous contract. She declares that she donated all of her properties as a dowry to her son, Gaspar de Sampaio, when he married D. Antónia Henriques, under the condition that he would employ that money in revenue to establish a chapel with annual masses for their souls in the monastery of Santíssima Trindade. She also appoints Estêvão Madeira, cónego da Se de Lisboa, as visitor of her chapel, giving him a pension in exchange for his supervision over it. After his death, the administrator of the entail shall elect the new visitor. She designates her son as administrator of the chapel, and his children afterwards. If he doesn't have any heirs, he shall appoint the next administrator among their relatives.

He establishes an entail with his third part, in which he includes houses in Lisboa which had an obligation of two masses for the soul of Lourenço Eanes, clérigo, and the houses in Montemor and estates of Antas and Carregais Cruzetes which had belonged to his mother, and which she had bequeathed to him for his entail, with an obligation of six annual masses. He also annexes to it his estate das Várzeas, a farmstead in Caparica and a farmstead in Montijo which he had received from Álvaro Lopes as an entail, with the obligation of an annual mass in the church of S. Pedro de Alfama. He orders a payment of masses for his soul and the souls of his parents, siblings, grandparents and great-grandparents.

After his nephew's death, the entail would be transmitted to his eldest son.
He establishes another entail with houses in Ameixoeira, lands in Calhariz, Arcas and Ponte Velha, appointing Heitor Machado, his nephew, to be its first administrator. He and his descendants are henceforth obligated to celebrate 10 annual masses for the institutor's soul in that church.
The testator also leaves a house in Figueira, two olive groves and lands in Junqueira to Mendo, his former slave. After his death, the properties would be annexed to the entail administered by Heitor Machado.

Will by which Pedro Botelho, do Conselho do Rei and juiz da Alfândega, and his wife, Isabel Eanes, express their wish to be buried in the monastery of S. Salvador of Lisboa. They declare that they were in possession of a farmstead with an olive oil mill and other houses in Lisboa which had belonged to Isabel Eanes' first husband, Afonso Eanes. He had bequeathed them to his wife, 36 years before, with an obligation of 90 annual masses in the church of S. Tomé of Lisboa: 30 for his soul and 60 for the soul of his first wife, Leonor Gonçalves. Pedro Botelho had made a contract with the priests of S. Tomé, 12 years before, to establish these masses, which they had fulfiled until then. They chose these properties for their third parts together with their houses and a store in Lisboa and establish an entail, which they bequeath their eldest son, Lopo Botelho, and his successors afterwards. The administrators shall order the masses established by Afonso Eanes and five annual masses for the souls of Pedro Botelho and Isabel Eanes in the church of S. Salvador of Lisboa. If Lopo Botelho dies without successors, the entail shall pass to his brother, Diogo Botelho, or to their sister, Beatriz, married to Pedro Moniz. If their lineage is extinguished, the future administrators will be chosen by appointment by the priests of Santo Elói.

Uma informação do encarregado do cartório das capelas, datada de 1842-02-11 (2.º vol., f. 30), refere que esta e outras capelas do comendador João José de Bettencourt e Freitas, foram reduzidas à pensão anual de uma missa rezada e um responso.

Filipa de Lacerda, designated Manuel Mendes de Eça, their only son, to administrate the chapel of Santa Catarina de Vila Rei, incorporating in it lands in Castro Daire ("prazo de Lamelas") and mills in Preguiça. They also entailed an olive grove (olival) and other lands in Alvelos ("prazo no Eiró de Alvelos"), properties in Tarouca ("prazo das Aldeias de Tarouca"), their farmstead and assets in Tondela to Francisco Mendes and Isabel Pais de Barros' entail, which they administrated. REDUÇÃO DE ENCARGOS: por sentença de 1818-12-14 (f. 106-135), as capelas administradas pelo Visconde de Torre Bela são reduzidas à seguinte pensão: missa aos domingos e dias santos (90 missas) celebrada por um capelão por 100.000 réis anuais; três missas de Natal por 2.400 réis; obras da capela do Carmo do Funchal conforme determinado pelo instituidor Manuel Martins Brandão; a capela de D. Isabel Bettencourt é reduzida a duas tochas para a igreja de Câmara de Lobos e duas tochas para São Bernardino.
BENS VINCULADOS / SUCESSÃO: as missas estão impostas em casas na Quinta Val de Amores, por cima da vila da Calheta. Já o encargo de mil réis ao Santíssimo Sacramento está vinculado a um foro pago por Gonçalo Álvares no serrado de São Sebastião, também acima da dita vila da Calheta. Esta fazenda é deixada a Ângela Rodrigues, mulher de Diogo Pires, pelos bons serviços prestados, porém, após a morte de ambos tornaria à fazenda do instituidor com o mesmo encargo.
Uma declaração do morgado António Correia Bettencourt , datada de 1746-02-10 (f. 52) refere que as casas desta capela “não servirem de utilidade (…) por na dita quinta não ter mais coiza alguma e venderam a Manuel de Faria e Almeida pela quantia de quinhentos mil réis”. Acrescenta que possuía no Pedregal uma fazenda no valor de 630.833 réis na qual já tinha dado em pagamento 154.856 réis à capela de António Correia, “o grande”, e nos restantes 475.977 réis impusera esta capela de Ana Morante. Os 24.023 réis em falta impõe em parte de uma fazenda denominada “Junsseira”, junto ao convento de São Bernardino. O juiz do Resíduo, por sentença emitida em 1746-02-14 (f. 53 v.º/54) julga aprovada esta imposição. O processo contém autos de embargo na novidade do serrado de São Sebastião, seguindo-se uns embargos interpostos por António Correia Bettencourt Henriques e uma apelação à sentença do Juiz do Resíduo.

Maria de Linhares se comprometia a “perpétuo silêncio” sobre umas demandas que traziam na Quinta de Val de Amores e trespassava livremente a António Correia Bettencourt Henriques três parcelas, a saber: as casas, o serrado da Rocha e o serrado de São Sebastião foreiro em 10 tostões à Confraria do Santíssimo Sacramento da Calheta, que seu avô comprara à dita confraria.
  • A sentença julga os embargos não provados, concluindo-se a constituição e obrigação do foro, mandando-se proceder à execução do mesmo em virtude do monitório embargado.

She appoints her niece, D. Beatriz, D. Álvaro de Silveira's wife, to be its first administrator, obligating her and her successors to give 24 000 réis each year to the convent of S. Domingos of Lisboa with the purpose of supporting the celebration of daily masses for her soul. Violante de Araújo, had agreed to establish an entail with their third parts, composed of several assets in Lisboa, Beja and Salvador da Baía. This entail should have the obligation of a daily mass celebrated in their chapel of Santo Estêvão, located in the church of the convent of Nossa Senhora de Jesus, in Lisboa, where they wished to be buried. He names his eldest son, Gaspar de Brito Freire, as first administrator of the entail and chapel, and his descendants, afterwards. Among his properties he lists the estate of Corte da Negra, in Beja, which his parents had bequeathed him as a chapel, and which he also passed to his son.
D. Violante de Araújo is present at the writing of this will and signs it, agreeing with the clauses concerning the institution of their entail and chapel, and with the annexation of her third part. Estêvão de Brito Freire allows her to revoke this confirmation if she wills it, under condition that his part should be kept.

ENCARGOS (ANUAIS): constituir uma capela na Igreja de São Brás “que he a capella que mando fazer aonde jaz meu pay e may (...), que custaria “ate cem mil reis”, ornamentá-la e celebrar uma missa diária pagas a trinta mil réis por ano. As quitações de missas referem que estas são celebradas na capela de Nossa Senhora da Consolação, sita no Arco da Calheta, fundada pela instituidora Isabel de Abreu, porém nunca se menciona que tal capela se encontra na Igreja de São Brás. Por sentença de abaixamento a favor de D. Francisco Henriques, sobrinho de D. Gonçalo Henriques, emitida em 1616-11-26 (f. 11-13), a pensão desta capela é reduzida a três missa semanais. O administrador alegara que ao tempo da instituição as terras vinculadas eram de canas e rendiam mais de 500.000 réis. Em 1733 o administrador António Correia Henriques ontem uma componenda de encargos pios (original em latim e tradução fl. 122-124). She designates Afonso Taveira, her grandnephew, Pedro Taveira's son, to administrate the chapel she and her husband established in the church of that convent. She entails to it her houses in Rua Nova, a farmstead (quinta) in Camarate and lands in Alcolena, determining that the chapel's future administrators must pay, each year, 3 800 reais brancos to that convent to support the pious obligations and give olive oil to light a lamp. They are also obligated to give to the convent's infirmary 200 reais brancos and to prepare a feast for the prisoners of the royal prison, every year.
The testator also bequeaths lands (casal) located near the bridge of Alcântara to her nephew, Rui da Grã, which should be passed to his descendants with the obligation of celebrating an annual mass in the church of S. Mamede of that city for the souls of Leonor Fernandes' parents.

She appoints her second-cousin, Aires de Saldanha de Sousa, as her universal heir, bequeathing him her entail and the chapel of Nossa Senhora de Jesus in the convent of Nossa Senhora da Graça of Lisboa, of which she was the administrator. He can appoint the next administrator among his descendants. If he dies without successors, the entail shall pass to Francisca's other cousin, Aires de Sousa de Castro, in the same way. She expresses her wish to be buried in her chapel of Jesus while the convent of Carmelitas she and her husband wish to establish isn't built.

Por sentença de 1818-12-14 (f. 123-149) as capelas administradas pelo Visconde de Torre Bela são reduzidas à seguinte pensão: missa aos Domingos e dias santos (90 missas) celebrada por um capelão por 100.000 réis anuais; três missas de Natal por 2.400 réis; obras da capela do Carmo do Funchal conforme determinado pelo instituidor Manuel Martins Brandão; a capela de D. Isabel Bettencourt é reduzida a duas tochas para a Igreja de Câmara de Lobos e duas tochas para São Bernardino.
SUCESSÃO: deixa a terça dos bens à suas três irmãs D. Joana, D. Francisca e D. Andreza, a fim de “se repartir pêra serem freiras”. Will made by Manuel da Costa in which he ordered, among other dispositions, the foundation of a chapel devoted to Jesus Christ with a perpetual mass obligation of a weekly mass celebrated on Sundays and holidays in the hermitage of N. Sra. das Almas. He named his wife Ana Rebelo as first administrator during her lifetime and, after her death, his son Inácio da Costa Rebelo who would always be succeeded, preferably, by the eldest male heir. If Inácio had no descendants, the administration should be given to one of his nephews, sons of Isabel da Costa. If there was none of them alive, the administration should be transmitted to another of his children. He ordered the administrator to continue the construction of a chapel which was not finished by the time of his death, and disposed that instead of giving account to the royal magistrates, the administrator should give account of the administration to a vigário of the church.

Will made by Manuel de Medeiros e Araújo and his wife Maria Arruda da Costa in which they ordered, among several other dispositions, the foundation of an entail with a perpetual mass obligation of one mass celebrated every week in the hermitage of N. Sra. da Rosa and a second perpetual mass obligation celebrated over their graves. They named one another as first administrator of the entail and their son Manuel de Medeiros da Costa after both of them were deceased, and from there on the succession should continue, preferably, on the eldest male heir. However, if Manuel died before assuming the administration of without heirs, they ordered the division of their reserved portions in two separate entails. The entail of Manuel de Medeiros Araújo would be administrated by his son Gonçalo de Medeiros with the same conditions and a perpetual mass obligation of a weekly mass. The entail of Maria de Arruda da Costa would be administrated by the same administrator of the entail founded by her parents Gaspar Dias and Ana de Medeiros.

Will made by Manuel Favela da Costa in which he ordered, among other dispositions, the foundation of an entail with a perpetual obligation of an yearly mass celebrated in the chapel where his grandfather, João de Arruda, was buried, in the monastery of S. André, Ponta Delgada, where his body should also be buried. He named his son António Favela as first administrator with the condition that he would chose one of his children to succeed him. However, the foundation of the entail depended on the conclusion of the partition deeds of his father Jorge da Mota and grandfather João de Arruda, from whose inheritances he expected to receive a sum. Finally, he also appointed his son António Favela as administrator of the entail founded by his wife Violante Mendes.

The institutor named her nephew Francisco de Campos as first administrator during his lifetime and, after his death, the succession should continue, preferably, on the eldest male heir. Will made by padre Bartolomeu Rodrigues in which he ordered the foundation of an entail with a perpetual pious obligation of thirty masses celebrated every year, with the prayers Inclina Domine, Deus veniat lergitor and Fidelium Deus. The institutor named an orphan boy named Marcos as first administrator during his lifetime and, after his death, he would be succeeded by his descendants, or, if he had none, the two council would elect an administrator to succeed him. The Alcaide António Dias Aldonso would administrate the entail until Marcos reached the age of fourteen, as his tutor.

Will by which Beatriz Gomes, mother of Cosme Bernardes, cavaleiro fidalgo da Casa do Rei, bequeaths her properties to her son, under the condition that he orders three annual masses for her soul and the souls of João Bernardes, Martinho Gonçalves, and Diogo Gomes in the monastery of Santíssima Trindade of Lisboa. Her son can appoint the next administrator among his children, and the chapel shall pass to their descendants afterwards. If he dies without succession, the entail shall pass to Beatriz's granddaughter, Maria Gomes, or to her nephew, Brás Serrão, son of Filipa Gomes, or to another person of Cosme's choice.
