Will

Will made in Portalegre by Ana de Miranda, in which she ordered, among other dispositions, the foundation of four entails. The first entail would be composed of a vineyard in the outskirts of Portalegre over which she imposed a perpetual obligation of three masses celebrated every year at Christmas, naming the eldest daughter of Catarina Delicada, who lived in Castelo de Vide, as first administrator during her lifetime, and, after her death, the succession should always continue on the closest relative of the Crato's lineage. The second entail would be composed of a land and a mill in the outskirts of Crato over which she imposed a perpetual obligation of two masses celebrated every year, naming her nephew Tomé da Silveira as first administrator, and, after his death the succession should always continue on the closest relative of the Crato's lineage. The third entail would be composed of a land over which the institutor imposed a perpetual obligation of one masses celebrated every year, and this would be administrated by her nephew padre Manuel Velez who would be succeeded by the closest relative of the Velez' lineage. Finally, this fourth entail would be composed of an estate named Herdade da Urra, over which she imposed a perpetual obligation of seven masses celebrated every year, and to administrate it she named her nephew Estêvão de Miranda, who would be succeeded by the closest relative of the Velez' lineage. All four entails would follow the succession patterns defined by the laws of the kingdom.

Will made by Sebastião Mendes Canto, in which he ordered, among other dispositions, the foundation of an entail and chapel with a perpetual obligation of sixty masses celebrated every year on the chapel of N. Sra. do Rosário of S. Lourenço's church, in Portalegre, where his body should be buried. His descendants could also be buried in the chapel if they wished so. He named his nephew Francisco, son of his niece Ana Mendes, as first administrator of the entail during his lifetime, and, after his death, the succession would always continue on the eldest male heir. If Francisco became a clergyman or if he died without heirs, the administration should be transmitted to his male brothers, preferably the eldest after him, or his sisters. In the lack of descendants of Ana Mendes, the administration would be handled to the Misericórdia of Portalegre, with the same conditions. All administrators would be obliged to annex up to 20.000 réis of their own reserved portion to the entail. The administrators should give account not to the Provedor das Capelas, but directly to the Prior of S. Lourenço's church. Anyone who committed crimes of lese-majeste would lose the administration of the entail.

Will by which João Esteves, Cavaleiro do Rei, Alcaide-mor de Lisboa and Privado de D. Fernando, asks his will executors to finish the construction of his chapel in the church of the convent of São Salvador, applying the third part of his assets to it. He entailed a farmstead (quinta) in Panasqueira, the farmstead (quinta) of Louras in Verdelha and houses in Lisboa, obligating the chapel's administrators to sustain two chaplains, who would celebrate daily masses for his soul; to give, each year, 5 libras to the cathedral of that city and 16 libras to the convent of S. Domingos of Santarém. He appoints his brother, Afonso Esteves, to be the entail's first administrator, allowing him to choose his successor.

Will made in Enxertal, parish of Nisa, by António Lopes, lavrador, in which he ordered, among other dispositions, the foundation of an entail composed of an olive grove with a perpetual mass obligation of one mass celebrated every year. He named his granddaughter Isabel as first administrator during her lifetime, and, after her death, the succession should always continue on the eldest heir, male or female. If she died without children, the administration would be handled to Domingos, grandson of the institutor.

Will made by António Rodrigues Pimenta, in which he ordered, among other dispositions, the foundation of an entail, composed of a land in Malhadinha Alta, over which he imposed a perpetual obligation of ten masses celebrated every year on the church of Santiago, in Marvão, where his body should be buried. He named his wife Domingas Lopes as first administrator during her lifetime, and, after her death, she would be succeeded by Maria, niece of the institutor, during her lifetime. After the death of Maria the administration would be handled to her sister Domingas, and from there on the succession should continue on the eldest heir of their mother's, D. Maria de Almeida, lineage.

Will made by Simão Fernandes, in which he ordered the foundation of two entails. The first entail would be composed of lands in Arez, would have a perpetual mass obligation of two masses celebrated every year and would be administrated by his nephew Manuel Mouro, his children and descendants after him. This second entail would be composed of all his remaining assets, and would have a perpetual mass obligation of one hundred masses celebrated every year in the mother church of Arez, and would be administrated by padre António Vaz, nephew of the institutor, during his lifetime and after his death the administration should be handled to his brother Manuel, and from there on the succession would always continue on the eldest male heir.

Will made by Álvaro Mexia and his wife Filipa Rodrigues in which they ordered their burial in the cathedral of Portalegre, in which they ordered the building of a chapel dedicated to Nossa Senhora da Luz and established three entails, each with an obligation of two masses over their tombs. The first one would be composed of an estate in Monforte, and would be administered by their daughter Guiomar Mexia and by her heirs. The second one would be composed by their estate of Caravides, in Assumar, and would be administered by their son António Mexia and by his descendants. The third entail would be composed of a property in ladeira de São Tomé and would be administered by their son Lopo Cabreira and by his descendants. If their lineage was extinguished, the administration of these entails should be transmited to the Confraria de Nossa Senhora da Luz with a perpetual obligation of one daily mass.

Will by which Aldonça Rodrigues instituted an entail with her olive groves and houses in Elvas, designating her brother, Álvaro Rico, to administrate it. After his death, he would be succeded by her nephew, Nuno Fernandes, Álvaro's son. All the entail's administrators were obligated to support the celebration of 5 masses, each year. The testator declared that her body would be buried in the cathedral of Elvas.

The entail's administrators were obligated to support the celebration of 2 annual masses for the institutor's soul in the convent of S. Domingos of Elvas, where her body would be buried.

ENCARGOS (ANUAIS): missa diária no convento de São Francisco pela esmola de 12.000 réis. Em 1738 (f. 46 vº-55) decorrem embargos interpostos por António Correia Bettencourt Henriques contra a sentença e determinação da conta tomada em 1733 (fl. 45 vº-46), em que se pretendia a fixação de uma taxa anual de 43.200 réis, visto que a esmola de 12.000 réis apenas dava para pagar 100 missas. Os embargos terminam com sentença do ouvidor geral da capitania, Dr. Luís da Silva e Brito, em que revoga tal sentença, mantendo a pensão taxada no testamento. Por sentença de 1818-12-14 (f. 106 a 143) as capelas administradas pelo Visconde de Torre Bela são reduzidas à seguinte pensão: missa aos domingos e dias santos (90 missas) celebrada por um capelão por 100.000 réis anuais; três missas de Natal por 2.400 réis; obras da capela do Carmo do Funchal conforme determinado pelo instituidor Manuel Martins Brandão; a capela de D. Isabel Bettencourt é reduzida a duas tochas para a Igreja de Câmara de Lobos e duas tochas para São Bernardino.

He named both his cousins Bento Garcia and Diogo Cardoso de Almeida to share the administration of the entail during their lifetimes and their eldest male heirs after them. He disposed that no administrator could ever marry a person of new-christian, hebrew or mulato descendancy.

Will made by Maria Delicado in which she ordered, among other dispositions, the foundation of an entail with a perpetual mass obligation of twenty masses celebrated every year on the chapel of N. Sra. do Rosário, in Alter do Chão. She named Pedro Mendes Garcia as first administrator of the entail, and after his death he would be succeedes by padre Sebastião Garcia. After the death of padre Sebastião Garcia, the administration would be transmitted to Inês Garcia with the condition that she and all successors after her would order the perpetual celebration of thirty masses every year. Inês would appoint a successor with the same conditions. Maria Delicado also named Maria Garcia as administrator of the chapel founded by Pedro Torto, wich was also a chapel whose succession was ruled by appointment.

Will by which Diogo de Sousa Carvalhal appointed Lourenço de Mizurado, son of Diogo Mendes de Vasconcelos, to administrate an unidentified chapel he administrated, with properties in Alter do Chão, Fronteira and Alter Pedroso. He also designated him to administrate a chapel instituted by Diogo de Rebelo in Avis. The testator bequeathed all his remaining assets to his wife, D. Margarida, obligating her and her successors to support the celebration of 10 annual masses for his soul in perpetuity. This chapel would be administrated, after his wife's death, by their son, Pedro Delicado, and subsequently by Lourenço Mizurado.
He determined that his body had to be buried in the convent of Santo António of Crato, where a grave with his coat of arms should be place. He donated a rent (foro) of one moio of wheat to the friars of that convent on the condition that they would celebrate a weekly mass for his soul in perpetuity.

Will made by João Fraústo de Faria, in which he named his son João Fraústo, absent of the Kingdom, to succeed him on the administration of a chapel he administrated, and ordered, among other dispositions, the foundation of a new chapel composed of two lands in Marvão's district, over which he imposed a perpetual obligation of nine masses celebrated every year on the in the church of the convent of N. Sra. da Estrela of Marvão, where his body should be buried. To administrate this new chapel he named his son António Nunes during his lifetime and his descendants after him, or, if he had none, this chapel would be administrated by the same administrator of the other chapel mentioned above.

The first entail would be composed of some houses in Marvão over which he imposed a perpetual obligation of one mass celebrated every year. To administrate it, he named his niece Leonor, daughter of Filipe Gonçalves, as first administrator during her lifetime, and, after her death, the succession should continue on the closest heir of her father's bloodline. He also left a land for padre Francisco Gomes, during his lifetime, with a perpetual obligation of one mass celebrated every year, and, after his death, this land should be incorporated on the entail administrated by Leonor. The second entail would be composed of the houses where the institutor lived, over which he imposed a perpetual obligation of two masses celebrated every year. To administrate it he named his cousin Francisco Rodrigues Canhoto and his descendants after him, or, if he had none, the administration would be handled to the closest relative that belonged to the lineage of the institutor's father.

The second entail would be composed of the houses where Diogo himself lived, and would have a perpetual obligation of four masses celebrated every year, and to administrate it he named Domingos Gonçalves, weaver, with the condition that he would appoint one of his children to succeed him with the same conditions. The third entail would also be composed of a vineyard on the city's outskirts, named Água da Cuba, over which he imposed a perpetual obligation of four masses celebrated every year, and to administrate it he named his nephew João Aparício with the condition that he would appoint one of his children to succeed him with the same conditions.

However, if Manuel wished to became a clergyman, he would only administrate during his lifetime, and, after his death, the administration would be handled to his sister Joana, and after the death of Joana to Pedro, their brother, and after his death to Maria Inchada, administrator of the first chapel, or, if none of them had children, to Sebastiana, daughter of Amaro Gomes and Leonor Miguéis, and, after the death of Sebastiana, if she also had no children, the administration would be transmitted to Maria, daughter of João Dias Rovisco, or the Confraria do Santo Nome de Jesus of Alpalhão.

After their death, their possessions, namely the grain rents, would be incorporated into the chapel, with the perpetual obligation to celebrate two weekly masses. Will by which padre Pedro Álvares Mergulhão expresses his wish to be buried in the parish church of Nossa Senhora da Graça of Montalvão. He establishes an entail composed of his properties in Montalvão, with a perpetual pious obligation of one sung mass and three trinitaries of masses celebrated every year in the eight days after All Saints Day. He named his niece Carrilho as first administrator of the entail during her lifetime and, after her death, she would be succeeded by Manuel, son of Álvaro Gonçalves, as long as he married with one of the daughters of Afonso Miguéis, and from there on the succession should always continue, preferably, on the eldest male heir.

Em 1819-01-28 (f. 26-29 v.º) o administrador João Carvalhal Esmeraldo Vasconcelos Bettencourt obtém indulto apostólico de componenda das pensões caídas das capelas que administra.
SUCESSÃO: designam o cônjuge sobrevivo, por falecimento de ambos nomeiam a filha Maria de Vasconcelos. Suceder-lhe-ia a filha que quisesse nomear, não a tendo passaria a um filho também à sua escolha; não tendo filho passaria ao outro filho dos instituidores, Luís, nas mesmas condições; não tendo filhos ficaria ao irmão Martinho e, sendo este clérigo, poderia nomear quem quisesse, mas os atrás designados só poderiam nomear pessoas legítimas.

DOCUMENTO/DATA DE INSTITUIÇÃO: testamento aprovado em 1694-11-10 pelo tabelião Manuel Rodrigues Pereira, nas casas de morada do testador na cidade do Funchal; aberto em 1694-11-13, na presença do juiz de fora corregedor Francisco Gomes de Góis.
MOTIVOS DA FUNDAÇÃO: encontrava-se doente, deitado em uma cama; pretende encaminhar bem as coisas de sua obrigação e consciências, por não saber o tempo em que o Senhor Deus iria chamá-lo; deseja firmemente e propõe-se acabar a vida na santa fé católica romana e "morrer dentro no regaso da sua igreja nossa madre com ajuda e favor divino" (f. 3); recomenda aos filhos que sejam sempre amigos e se conservem no amor e união que sempre tiveram, acrescentando que teriam a benção de Deus e sua se na partilha dos bens não houvesse dúvidas nem "couzas que escandalizem".
ENCARGOS PERPÉTUOS: anualmente, uma missa cantada com diáconos na sua capela de São João, convento de São Francisco, no seu dia, pela sua alma e de seus sucessores; consertar e enramar o mesmo templo, o qual era jazigo de seus avós e onde se manda enterrar, "asim como o costumei sempre fazer" (f. 5).
REDUÇÃO DE ENCARGOS: na conta prestada em 1796-03-12 (f. 1), menciona-se como encargos apenas a aludida missa por 1200 réis. A informação do procurador do Resíduo (f. 28 v.º), esclarece que pela redução de 1814-03-20 esta capela foi anexa à capelania de Nossa Senhora da Vitória da Ribeira dos Socorridos, com a obrigação de vinte missas por esta e outros instituidores. Em 1819-01-28 (f. 30-36), o administrador João Carvalhal Esmeraldo Vasconcelos Bettencourt obtém indulto apostólico de componenda das pensões caídas das capelas que administra.
SUCESSÃO: nomeia o seu filho Francisco de Vasconcelos Bettencourt, sucedendo-lhe o filho macho mais velho e assim irá continuando em seus descendentes. Na falta de geração da linha direita do instituidor "que direitamente de mim procedam ou descendam", a terça ficaria aos pobres do hospital da cidade do Funchal, com as obrigações seguintes: trezentas missas anuais, com esmola de 30.000 réis pagos aos quartéis aos dois capelães colocados pelo provedor e Mesa; 40.000 réis para ajuda de cada uma de duas moças pobres, honradas, de bom viver e as mais necessitadas, cuja eleição muito cuidada sujeitava ao conselho e parecer do bispo. O provedor não poderia alhear nem dividir os bens, antes deveria conserválos e aumentá-los, e obrando em contrário os mesmos passariam logo ao Colégio da Companhia de Jesus do Funchal.
BENS VINCULADOS: terça dos seus bens em capela e morgado, escolhendo o instituidor toda a fazenda no Arco da Calheta, comprada às freiras da Esperança de Lisboa; junta ainda os seus panos de raz para andarem em morgado (f. 7 v.º). A terça andaria sempre junta e unida, sem se poder partir, nem vender, nem alhear, nem trocar.
SUB-ROGAÇÃO DE BENS: as verbas declaratórias, datadas respetivamente de 1847-12-23 (f. 40/40 v.º) e 1851-11-12 (fl. 41/42), referem a sub-rogação de bens desta capela situados na cidade do Funchal e não no Arco da Calheta, como se segue: i) terreno na rua da Conceição, Sé, no valor de 683.361 réis e o capital de um foro no valor de 200.000 réis imposto num terreno na Calçada da Encarnação, Santa Luzia, os quais foram sub-rogados por benfeitorias livres, em idêntico valor, no Palheiro Ferreiro;
ii) casas n.º 21/23 e 29/31 sitas na rua das Pretas, São Pedro, avaliadas respetivamente em 476.000 e 432.000 réis, as quais foram sub-rogadas por parte de um terreno sito nas Angústias, São Pedro.
OUTROS BENS VINCULADOS: i) terça da mãe do instituidor: os bens totalizam 8.000 cruzados e ainda não haviam sido apartados. Agora nomeia a filha Leonor na sucessão e designa os seguintes bens: fazenda do Nateiro no lugar da Madalena; fazendas da Ponte e Bacelo; horta na rua do Pinheiro, Funchal, comprada a Francisco Fernandes Campos; outras propriedades até perfazer o valor atrás previsto. ii) terça de D. Branca: informa-se da sucessão deste vínculo, a saber, a filha D. Helena de Vasconcelos, seguindo-se D. Beatriz da Silva e Francisco de Vasconcelos Bettencourt “o Velho”. Este nomeia como sucessor o filho Francisco. iii) bens vinculados ao morgadio de D. If she had no children or grandchildren, then the administration would be handed, in this order, to her husband António Zuzarte, her sisters Inês dos Serafins and Catarina da Encarnação, her nephew Diogo Barradas and from there on the succession should always continue, preferably, on the eldest male heir. If Diogo had no children, the administration would be handed to his sister Leonor Barradas de Veiros, or their aunt Maria Curvo, or to other relatives. If her lineage became extinguished, the administration would be transmitted to the Misericórdia of Monforte. Will made by padre Simão Rodrigues da Costa in which he ordered, among other dispositions, the foundation of an entail with a perpetual pious obligation of ten masses celebrated every year on the Cathedral or on the Jesuit church of Portalegre, in the chapel that should be purchased for the burial of his body. The institutor named his nephew Francisco Reixa da Costa as first administrator during his lifetime and, after his death, he would appoint a successor to succeed him with the same conditions, preferably one of his male children or strictly blood relatives. He also bequeathed some properties to João Marques to sustain and pay for his studies with the condition that he would became a clergyman, and, after his death, those properties should be annexed to the chapel. The institutor ordered the first administrator to register this will and the entailed properties on the Tombo record books of the Provedoria of Portalegre.

Carreiras, Pedro (d.1583)

Will made by Manuel Martins Rol, in which he bequeathed 70.000 réis, a vineyard and a land to his brother Francisco Rol de Velez and ordered the foundation of an entail with a perpetual pious obligation of two masses celebrated every year. He named Francisco as first administrator of the entail and, after his death, the succession should always continue, preferably, on the eldest heir, or, if he had none, the administration would be transmitted to his brother António Rol de Velez or his sister Margarida de Velez. The administrators were expressly forbiden to marry with new-christians and illegitimate children could never receive the administration. The institutor also ordered that half of a vineyard should be annexed to the reserved portion bequeathed by Joana Dias, nicknamed a Cereja, as long as it remained on the Reis family.

Rol, Manuel Martins (d.1681)

Will by which Catarina Lopes expresses her wish to be buried in the convent of S. Francisco of Portalegre. She establishes an entail with a perpetual pious obligation of twenty masses celebrated every year. She named her husband Manuel Mendes Tavares as first administrator during his lifetime and, after his death, he would be succeeded by Manuel da Rosa, son of Pedro Rombo Tavares. After his death, Manuel would be succeeded by his brother Domingos Rombo Tavares, if he still lived, and from there on the succession should always continue on the closest and eldest male relative of the institutor's lineage.

Lopes, Catarina (d.1683)

Will made by Leonor Delicado in which she bequeathed all her assets to the Society of Jesus with the condition that they should establish a college in Castelo de Vide. However, if the Society did not accepted her conditions, she orders the foundation of two entails.
The first entail would be composed of a farm she owned in Alpalhão, over which she imposed a perpetual pious obligation of two masses celebrated every year, and to administrate it she named her nephew padre Manuel Delicado during his lifetime. After the death of Manuel, he would be succeeded by Maria Gomes Delicada, niece of the institutor, and from there on the succession should always continue, preferably, on the eldest female daughter. All administrators of this first entail should bare the surname "Delicado", keep a record book for the registration of the masses that should be checked by the Misericórdia of Alpalhão, in every year, and they would be also obliged to annex one property worth 30.000 réis to the entail.
The second entail would be composed of all the root assets the institutor owned in Castelo de Vide, over which she imposed a perpetual pious obligation of three masses celebrated every year, and to administrate it, she named her nephew padre Diogo Afonso Tarouca during his lifetime. After the death of Diogo, the administration would be handled to Francisco Fernandes Tarouca, nephew of the institutor, and from there on the succession should always continue, preferably, on the eldest female heir. Just like the first entail, all administrators of this second entail should bare the surname "Tarouca", keep a record book for the registration of the masses that should be checked by the Misericórdia of Castelo de Vide, in every year, and they would be also obliged to annex one property worth 30.000 réis to the entail. The administrators of both entails should give 10.000 réis to the chaplain of N. Sra. da Vitória's hermitage, founded by the institutor and her husband António Mouzinho Galeano, with the perpetual pious obligation they imposed of two masses celebrated in every week, on Saturdays and Sundays.

Delicado, Leonor (flor.1663-1668)

Will made in Vale do Peso, Portalegre's district, by padre Manuel Dias Maninho in which he ordered, among other dispositions, the foundation of an entail and chapel with a perpetual pious obligation of five masses celebrated every week on the chapel and altar of Almas, where his body should be buried. He named his compadre Salvador Martins as first administrator of the entail during his lifetime, and, after his death, he would be succeeded by Manuel Luís, son-in-law of Salvador, and his descendants after him, or other appointed administrators in case he died without heirs. The administrators should also give 30.000 réis every year to the chaplain's sustenance, providing him a house, choosing him among the local born clergyman, preferably learned in universities and old christians, who would be examined before taking on the administration. He also disposed that the administrators were obliged to provide the dowry and marry an orphan girl every year, chosed among his relatives. Predicting that the entailed patrimony could occasionaly dismantled in times of war, famine or plague, he allowed that the number of masses, the chaplains salary and the orphan girls dowry could be reduced in any of those circumstances.

DOCUMENTO/DATA DE INSTITUIÇÃO: testamento (f. 2-16 v.º) aprovado em 1640-02-06, nos aposentos onde vivia o testador, na Freguesia de São Pedro (Funchal), pelo tabelião de notas do Funchal e seu termo por el-rei, António Gonçalves Boim; aditamento de 1616-02-17 ao testamento, o qual ficara aberto a pedido do testador; aberto em 1640-03-10, na presença do juiz ordinário desta cidade, João da Fonseca de Vasconcelos.
MOTIVAÇÃO DA FUNDAÇÃO: estava enfermo de doença que Nosso Senhor lhe dera e não sabia a hora em que seria servido de o chamar; "descargo de minha consiensia e declarassam de minha ultima vontade" (f. 2 v.º). Mais à frente (f. 8), esclarece que "he a principal tensão porque fundo esta capela gozarmos [a sua alma e a daqueles de quem herdou os bens] destes sufragios e despender-se o rendimento dos ditos bens de rais em que fundo a dita capela para sempre".
ENCARGOS IMEDIATOS: i) ao dia do falecimento, todas as missas que forem possíveis por sua alma, no convento de São Francisco do Funchal e demais igrejas desta cidade, por esmola de 60 réis cada uma, as celebradas no altar da Sé por 70 réis; ii) nos primeiros dias após o seu falecimento, e no mesmo convento, três ofícios de nove lições por sua alma, com vésperas e oferta de dois sacos de trigo, dois barris de vinho e um carneiro por cada ofício; outros três idênticos ofícios e ofertas na Sé; iii) com a maior brevidade possível, e ainda por sua alma, 4000 missas nas igrejas desta cidade, sendo as celebradas na Sé pagas com esmola de 60 réis, as restantes com 50 réis. Todos estes e outros legados e gastos por sua alma seriam assegurados pelos seus bens móveis, alocados para esse efeito.
ENCARGOS PERPÉTUOS (ANUAL): i) um anal de missas por sua alma na capela do Santíssimo Sacramento da igreja de São Pedro (Funchal), que manda construir por sua devoção ("fundem e fasam de novo") e ornamentar com um painel de Nossa Senhora de Monserrate, mandado vir de Lisboa, cabendo ao senhor bispo a eleição do local mais conveniente para a sua ereção. Para a edificação de tal capela, reserva 400.000 réis e determina que se fixem as suas armas no arco da mesma "ou onde melhor cair", em memória da sua fundação; ii) outros dois anais de missas por sua alma e de seus defuntos, ditos por ordem dos priostres do cabido, com a esmola acostumada; iii) 4000 réis para reparo e ornato da aludida capela. Uma nota na folha de rosto dos autos refere que os encargos totalizam 19.500 réis (em 1796).
REDUÇÃO DE ENCARGOS: a informação do procurador do Resíduo (f. 29 v.º), esclarece que, pela redução de 1814-03-20, esta capela ficou limitada à pensão de vinte missas anuais e no mais anexa à capelania da Lombada. Em 1819-01-28 (f. 32 v.º-37 v.º), o administrador João Carvalhal Esmeraldo Vasconcelos Bettencourt obtém indulto apostólico de componenda das pensões caídas das capelas que administra.
SUCESSÃO: institui sua alma herdeira de todos os seus bens de raiz e como administrador da capela seu sobrinho José, filho de sua irmã D. Antónia de Moura, sucedendo-lhe o filho primogénito varão "e nessa conformidade se continuara para sempre"; não tendo filho macho passaria a fêmea, não tendo filha sucederia na administração seu irmão João e descendentes, mas já na linha direita do filho secundogénito, "porquanto hé minha vontade que nunca esta capela anexa ao morgado de seu pai Bartolomeu Machado de Miranda, salvo em cazo que desta linha haja hum só filho mas em avendo segundo logo quero que lhe passe a dita admenistrasam" (f. 9 v.º); caso o irmão João não tenha filhos passaria à outra irmã mais velha que fosse casada, sucedendo sua filha ou filho na forma acima declarada. Na falta de geração desta linha dos nomeados, a administração do vínculo ficaria à Confraria do Santíssimo Sacramento de São Pedro para cumprimento dos legados e o remanescente para os gastos da confraria.
INCUMPRIMENTO DE ENCARGOS(f. 10-10 v.º): o não cumprimento dos encargos "de hum ano para outro" acarretaria a perda da administração para a aludida confraria em vida do administrador remisso.
FISCALIZAÇÃO DE ENCARGOS: o instituidor deixa cinco tostões anuais ao juiz dos Resíduos que fiscalizar o cumprimento desta capela, isto se inteiramente a fizesse cumprir. Por outro lado, é peremptório ao determinar que em tempo algum não se pudesse baixar os respetivos encargos.
BENS VINCULADOS: todos os seus bens de raiz havidos e por haver "e nos de raiz instituo capela para sempre" (f. 7 v.º). O remanescente do rendimento de sua fazenda ficaria para os administradores nomeados pelo seu trabalho "e assim se cumprira tudo o que atras tenho dito" (f. 11 v.º).
SUB-ROGAÇÃO DE BENS: a verba sub-rogatória, datada de 1859-11-15 (f. 44/46) declara que fica sendo livre e alodial uma porção de terra na freguesia da Camacha, no valor de 618$380 réis, pertencente a esta capela, a qual foi sub-rogada por cinco porções de terra no Pico do Infante, São Gonçalo.
OUTROS VÍNCULOS: o testamento determina a doação de verbas para aquisição de três foros, cujos rendimentos seriam aplicados na celebração de missas perpétuas, como se segue: i) 50.000 réis à confraria de Nossa Senhora da Conceição da Sé, com pensão de uma missa anual; ii) 40.000 réis à confraria das Almas da igreja de São Pedro, com obrigação de uma missa mensal e um responso às segundas-feiras; iii) 10.000 réis à confraria de São Pedro com pensão de três missas anuais. Todavia, neste processo não se prestam contas destes vínculos.

He established an entail composed of a watermill with the obligation of a weekly as long as the world lasted. To administrate it he named his nephew Inácio, son of Simão Rodrigues and Lucrécia Mendes, sister of the institutor, and his descendants after him. If Mécia Fernandes, sister os the institutor wished to entail her own reserved portion to this entail, then the perpetual masses obligation would be increased from one to three masses celebrated every week.

She annexes her reserved portion, consisting of four estates, to the entail founded by her father Estêvão Nogueira. She also establishes an entail with the remaining part of her properties, to be annexed to her father's with a perpetual obligation of five annual masses. She names her son Manuel de Andrade as first administrator of this new entail and also as successor on her father's entail, following all the succession clauses disposed by Estêvão Nogueira. She also disposed that all future administrators should henceforth use the surname Andrade Nogueira, and would be obliged to annex assets worth 20 000 réis to the entail, declaring expressly that she wished all administrators of the entail to be "very rich in order to make many services to God and to the poor people".

MOTIVOS DA FUNDAÇÃO: a testadora encontrava-se doente, jazendo numa cama; disse que temia o dia e a hora do seu falecimento e não sabia quando seria nem o que o Senhor Deus lhe tinha ordenado de fazer; descarrego de sua alma e de sua consciência.
ENCARGOS PERPÉTUOS: uma missa semanal ao sábado e outra cantada em dia de Finados, por sua alma, no convento de São Bernardino, na sua capela «que ela e o dito seu marido fizerão» (f. 3 v.º); ainda o «carrego de retelhar a dita capela que não chova nela» (f. 5 v.º).
REDUÇÃO DE ENCARGOS: a informação do procurador do Resíduo (f. 26), esclarece que, pela redução de 1814-03-20, esta capela ficou anexa à capelania da Lombada e limitada à pensão de oito missas anuais. Em 1819-01-28 (f. 28-33 v.º) o administrador João Carvalhal Esmeraldo Vasconcelos Bettencourt obtém indulto apostólico de componenda das pensões caídas das capelas que administra.
SUCESSÃO: a filha D. Helena de Vasconcelos, mulher de Henrique de Bettencourt. Suceder-lhe-ia o filho Rui Mendes (neto da instituidora), depois o filho varão mais velho deste, e daí em diante por seus descendentes para sempre, privilegiando-se a primogenitura de preferência masculina, só entrando uma filha no caso de não haver um filho macho. Na falta de descendência da instituidora ficaria ao parente mais chegado do neto Rui Mendes.
BENS VINCULADOS: todos os seus bens móveis e de raiz «por onde quer que fossem achados» (f,. 4 v.º), nos quais faz sua alma herdeira.

As aludidas casas confrontavam com o Largo do Calhau e Largo do Poço, e foram respetivamente avaliadas em 477.000 réis, 476.000 réis e 305.813 réis.

To administer it he named his niece Maria, daughter of Diogo Soares and Beatriz Francisca, and her successors afterwards. The second entail would be composed of a tapada in São Pedro and would be administered by Catarina Francisca, Maria's sister. It would have a perpetual obligation of three annual masses in the Misericórdia. Catarina would be succeeded by her daughter Isabel and from there on the succession should always continue on the eldest heir.

Bartolomeu of Vila Flor and established five chapels, with a perpetual obligation of three masses each, naming her nephews Manuel Ribeiro, Maria Pais, Manuel Marchão da Rosa, Pedro Dias de Albarrol and António Martins da Rosa Albarrol to administrate their respective entails during their lifetimes, and, after their deaths, each one would be succeeded by the eldest heir, except for the chapels of Manuel Ribeiro and Maria Pais, in which the succession should always continue on the closest relative. The properties given to Manuel Ribeiro should include the land of Beco and a tapada in Vila Flor. Whomever inherited her houses would also inherit her wine cellar.

The administrator had the power to appoint his successor, and female children would be preferred to male. The second entail was in favour of her niece Maria Gonçalves, it was composed of her farmlands and had the obligation of six annual masses. After her death, the properties should be transmitted to the closest relative.

ENCARGOS (ANUAIS): duas missas e meia rezadas e uma cantada no convento de São Francisco. Em 1803 (f. 56-60) breve de composição de encargos pios.
REDUÇÃO DE ENCARGOS: de acordo com declaração do encarregado do cartório, José Maria Rodrigues, datada de 1841-09-07 (f. 96 v.º), as capelas desta casa foram reduzidas a 20.000 réis pagos ao Seminário desta província, constando a sentença de redução dos autos da capela de Francisco d'Arja Teixeira.

SUCESSÃO: Herdeiro de toda a fazenda: a sobrinha Beatriz, filha dos sobrinhos João Nunes e de Guiomar Ferreira, devendo os pais administrar a fazenda até a filha casar. Não tenho a sobrinha sucessão, herdaria a outra sobrinha Maria, filha do mesmo casal. O encargo de cinco missas rezadas e duas cantadas, fixado no testamento de mão comum, é dividido pela metade e as capelas dos instituidores seguem um diferente ramo de administração. Em 1624, a metade da propriedade relativa à capela de Domingos de Braga (que possui a cota atual Cx. 172-1) está arrendada a Francisco de Lima “o Velho”, e a outra metade de Beatriz Nunes a António Nunes de Azevedo. Aliás, no mesmo processo de Domingos de Braga, a f. 24, e em 1611, Pedro Nunes Furtado esclarece junto do Convento de São Francisco que ele era obrigado «a dar conta» da totalidade da capela até 1601, pois a «fazenda andou sempre junta» até esta data. Mas, por morte da sua mulher Beatriz, «está partida pelo meio entre ele e seu pai [João Nunes Cardoso] e sua irmã Maria Henriques, conforme era o testamento».

Acrescenta também desconhecer qual a fazenda vinculada a esta capela.

Will of Francisco Rodrigues. He orders his burial in his chapel of Anjo Custódio, in the mother church of Chaves, to which he attaches various assets, in order to fulfill charges. He appoints Jácome Rodrigues Carneiro, his son, to administer it. He was administrator of a chapel established by Filipa Rodrigues, his sister, for which he appoints João Doloria, his nephew.

Will by which Maria Pegado, João Pais' widow, bequeathed all her remaining assets to her nephew, Martinho Pegado, determining that he and his descendants had to support the celebration of an annual mass for her soul in the church of Salvador of Elvas, where her body would be buried. After his death, the entail would be transmitted to his son, António. The latter would be succeeded by one of his children or, if he died without leaving offspring, by an elder brother.

He also instituted another chapel, entailing half of a third of his assets to the fulfillment of charges. He appoints his nephew to administer it, with the obligation of helping D. Maria de Vasconcelos, in the religious profession. He attached the other half of the third part of his assets to the entail he administered, in order to fulfill the institution.

Will by which Ana Dias Copim, widow, establishes an entail with houses in Rua das Fangas da Farinha, Lisboa, instituting the pious obligation of celebrating two weekly masses for her soul in the chapel of Jesus of the church of the convent of S. Domingos of that city. She appoints her cousin, António Vogado, to be its first administrator, imposing him the obligation of buying another property destined to be incorporated in the entail. She declares that her remains should be buried in the Chapel of Santa Cruz of that convent, next to her mother, aunts and husband.

The second entail would have a perpetual pious obligation of twenty masses celebrated every year and to share the administration she appointed her grandsons Francisco Dias and Sebastião Dias and their descendants. This entail is composed of a vineyard located in Alpalhão.

After her death, she should appoint a son or daughter to succeed her with the same conditions, and the succession should continue by appointment. She left her niece somo houses and some "castanheiros" in Castelo de Vide and its outskirts. The second entail would have a perpetual pious obligation of two masses celebrated every year as long as the world lasted, and should be administrated by her niece Isabel Vidal during her lifetime. After her death, she should appoint a son or daughter to succeed her with the same conditions, and the succession should continue by appointment. She left her some movable goods from the houses she possessed in Castelo de Vide. She also disposed that all entailed properties of both entails should be registered on the record books of the Provedoria das Capelas.

No administrator could ever marry with a person of the so-called "infected races" and was obliged to present an account of the administration to the Misericórdia of Castelo de Vide in every two years.

This entail is composed of houses in Marvão. The second entail would have a perpetual pious obligation of four masses celebrated every year and would be administrated by Mateus Pires, his brother, during his lifetime and, after his death, the administration would be handled to the closest relative of the institutor lineage. This entail is composed of land located in Vale de Figueiró. The third entail would have a perpetual pious obligation of five masses celebrated every year and would be administrated by his Leonor Pires, sister of the institutor, during her lifetime and, before her death, she would appoint one of her children or a close relative to succeed her on the administration. This entail is composed of a "souto" in the place of Arraial.

This entail is composed of some lands in Folha de Figueiró and some houses in Castelo de Vide. The administrators of both entails were obliged to give account of the administration to the Provedor da Misericórdia of Castelo de Vide in every three years, and never to the Provedor das Capelas.

The second entail would have a perpetual pious obligation of also four masses celebrated every year and, to administrate it, during his lifetime the institutor named his brother Manuel Vaz Sarzedas, and, after his death, the succession should always continue, preferably, on the eldest male heir. The institutor disposed that the administrators of both entails were obliged to give account of the administration to the Provedor da Misericórdia of Castelo de Vide, and not to the Provedor das Capelas, in every two years, registering the entailed assets in the Provedoria's record books.
