Adoption deed

Adoption deed by which Pedro Vacão and Catarina Pires, his wife, adopt Diogo Barbuda and Beatriz Morais, his wife. They donate a third of their property, after their deaths, to fulfill the charges for their souls, celebrated in the church of Santa Maria do Porto, where they wished to be buried. After the death of first administrators, it was to be left to their eldest son, whether male or female.

Chapel foundation deed by Genoveva Pereira da Cunha, António Ribeiro Pereira, Vicente Pereira de Castro and D. Leonor Soutomaior. Fulfilling the will of Doutor Nicolau Pereira de Castro, son of Genoveva Pereira da Cunha, she established a chapel with a third of his assets and of his son, to fulfill the charges, celebrated in the church of Nossa Senhora da Salvação in Arruda dos Vinhos. It also encloses the assets left by priest Manuel Pereira, her son, before his profession. According to the same will, he appoints Vicente Pereira de Castro, first administrator. The succession was to be that set forth in the Kingdom Ordinances. Priest António Ribeiro Pereira would also entail, on his death, his property to the aforementioned chapel. Vicente Pereira de Castro and D. Leonor Soutomaior, his wife, also attach a third of their property, namely the Nossa Senhora da Luz' farm, in Vinha, on the outskirts of Arruda dos Vinhos, to the chapel.

Chapel foundation deed by which Isabel Afonso Pinto ordered the foundation of a chapel with a perpetual pious obligation of twenty masses celebrated every year in the church of Santa Maria do Bispo, in Montemor-o-Novo. She appointed Beatriz André to be the first administrator during her lifetime and, after her death, she shall be succeeded by her eldest son or daughter. After the death of Beatriz André's eldest son, he would pass the administration to the next sibling, from the oldest to the youngest. After the death of the youngest, the administration would pass to the eldest grandson or granddaughter.

In case of non-fulfillment of the charges, the administration would transfer to Santa Casa da Misericórdia of Viana.

Codicil of Tomás de Bairros and Joana da Costa, his wife, revoking their will (dated 1559-10-29) and previous codicil. They order their grave in the same chapel as Jesus, in the church of Nossa Senhora do Funchal, in Ameixoeira. They instituted an entail and appoint whatever survives from them heir and administrator. They reduce the determined charges and appoint Damião Borges, to administer it after the death of both, if he married Isabel da Costa, Joana da Costa's niece. His son would succeed him. If the marriage did not materialize, the administration would fall to António Gonçalves and then to his eldest son.

Codicil by which Cristóvão de Brito, D. Beatriz de Ataíde's husband, member of the Conselho do Rei, establishes an entail with public debt instruments and a farmstead (quinta) in Ribatejo, appointing João de Brito, his nephew, to be its first administrator. The latter and his descendants are obligated to support the celebration of annual masses for the soul of the institutor in the chapel of Nossa Senhora da Assunção of the church of the monastery of Madre de Deus of Lisboa and to maintain alight a lamp inside it. Followed by an approval deed issued on 1560-03-25 and an opening deed issued on 1561-08-09.

Codicil of Catarina Rodrigues Pimenta, widow of João Fernandes, ordering the fulfillment of the previous will done together with her husband. She established a chapel, at the hermitage of Santo António, near Moura, entailing the real estate he owned with that hermitage to fulfill the charges. She appoints António Rodrigues, her husband's nephew, as the first administrator. She orders that, after his death, the administration be transferred to the same administrator of the principal chapel, and then remain in the same administrator.
She appoints Álvaro, nephew of João Fernandes, son of Lourenço de Pina, his co-brother cousin, and Inês Fernandes, as administrator of the chapel of Nossa Senhora da Conceição. However, he could only receive it after completing 25 years, until then, being administration by Cristóvão de Almeida, nephew of the institutor. If the first died before reaching that age, or without children who could inherit it, he would be left to Cristóvão de Almeida and if he died without legitimate children, to António de Pina, son of Rui de Pina, also only after turning 25 years old.
It also contains an approval deed (dated 1516-08-09), and an opening deed of a will (dated 1518-03-07).

Codicil by which Ana Luís revoked a clause of her will, in which she demanded that the entail's following administrators should give, each year, 100 réis to the Confraria das almas do purgatório of the church of Santa Justa, whose officers should ask the visitador to take the chapel's administration account. Instead, she ordered that the Solicitador das capelas do Hospital de Todos-os-Santos should take an exemplification of the wills she and her late husband had issued, and introduce that information in the Tombo of the said hospital. The Solicitador was asked to supervise, each year, if the pious obligations they instituted were being fulfilled, in exchange for a tostão. Followed by the approval deed, issued on 1569-08-27, and the opening deed, issued on 1577-07-10.

Confirmation letter by Mem da Costa Saraiva of the entail founded by his parents, Pedro Saraiva da Costa and Ana Frajoa da Costa, and clauses' declaration. Her mother was present and consented in this confirmation and presented clauses. This is a second document, since the first one was forged by Manuel da Costa Saraiva, brother of Pedro Saraiva da Costa, changing the clause which excluded him and his descendants from the entail's succession.

Donation deed made by Francisco Vaz Morujo, his wife Isabel Vaz and Catarina Vaz Morujo, his sister, in which they donated some houses, lands and other properties to their son and nephew Manuel Vaz thereby ordering the foundation of an entail with a perpetual pious obligation of fifty masses celebrated every year as long as the world lasted in the church of S. Lourenço, in Portalegre, where their bodies should be buried. The only condition was that Manuel should become a clergyman within a year, administrating the entail during his lifetime and, after his death, he would appoint his sisters Catarina de Sena and Isabel das Montanhas, both of them nuns at Santa Clara's convent, to succeed him, and, after the death of Isabel or Catarina the last one alive would appoint a person to succeed on the administration.

Pedro de Castilho, Bispo de Leiria, donates lands (casais) in Golegã to his nephew, Diogo de Castilho, with the obligation of celebrating masses for the souls of Pedro's parents in the altar of S. João Baptista of the Mosteiro de Santa Cruz of Coimbra. Diogo de Castilho gives his consent to this donation.

Donation deed by which Aníbal Sernige donates to Manuel Sernige, his son, several properties located on the outskirts of Porto, Feira, Aveiro, Esgueira and Ílhavo, as an entail. The administrator was responsible for appointing the successor from among his sons. If not, it would be for the eldest. The charges were to be celebrated in the hermitage of Nossa Senhora, in the place of Sá, on the outskirts of Ílhavo. In case of extinction of the lineage, he would stay in that hermitage. Manuel Sernige and Maria Ferreira, his wife, accept the conditions of the donation, undertake to fulfill the charges and attach other properties to the entail.

Donation deed made by Pedro Fernandes Poupano and his wife Beatriz Vaz Dourada ordering the foundation of an entail, composed of an estate in Carril, district of Portalegre, which was donated to their grandson Manuel Vaz Dourado, with condition that he and his descendants should celebrate perpetually, as long as the world lasted, 10 masses every year. If he died without heirs, the administration should be transmitted to his brother António Pires Cavaleiro or his sister Maria Vaz Dourada. If none of them had children, the administration of the entail should hand down to the closest relative of Beatriz Vaz Dourada.

The houses and backyards will be the entail's head. She also orders her husband to found this entail and list its conditions.

Dowry deed by Isabel Gomes, widow of António Álvares Estaço, to her daughter, Jerónima Madeira, on the ocasion of her marriage to Simão de Seixas, son of Simão de Seixas and Madalena Fernandes. Part of the dowry is made up of a public debt instrument, which she entails with an obligation of masses in the convent of S. Francisco de Xabregas, Lisboa, to be administered by Jerónima Madeira and her husband, and by the successors of her marriage.
Contains a will chart (extract) of António Álvares Estaço and the respective approval deed, dated 1560-03-29; and a grace warrant issued to Simão de Seixas, escrivão of the Alfândega of Lisbon, allowing him to leave the office to one of the sons, dated 1559-07-01.

Dowry deed by D. Fernando Coutinho, bishop of Algarve, to marry Rui Pereira, son of João da Silva, regedor das justiças do reino, to D. Isabel Coutinho da Silva, daughter of D. Fernando, giving them all his assets as an entail, with the pious obligation of a perpetual annual mass. The institutor defines some accumulation clauses regarding this entail and the entail of João da Silva. Only Rui Pereira, if he inherits his father's entail, and his male son can succeed in both entails. After them, these entails should be separated.

Dowry deed by which Beatriz Soares, Diogo Fernandes' widow, donated houses in Cata-que-farás, Lisboa, and a part of the sugarcane plantation she owned in Ilha de S. Tomé, which produced 250 arrobas of sugar every year, to her niece, Filipa Soares, Pedro Soares and Beatriz Lopes de Segura's daughter. She and her descendants were obligated to support the celebration of 2 weekly perpetual masses and a mass each November, for the souls of her late husband and of her son, in the church of Nossa Senhora dos Mártires. Those properties could never be sold or exchanged for others. If her niece died without leaving descendants, the entail would be inherited by one of her brothers and sisters.

Entail foundation and annexation deed by Simão da Cunha and D. Luísa de Almeida, his wife, with the remaining of their available portions and entailing it to the entail founded by Guiomar de Sequeira, D. Luísa's mother, in her will, dated from 1578-05-13. The institutors describe all the entail foundation clauses and mention that the entail founded by Guiomar de Sequeira included her available portion, a part of the available portion of Simão Ferreira, her husband, and the reserved portions of Ana da Madre de Deus, their daughter and sister of D. Luísa de Almeida. They also request to the king the confirmation of this entail foundation deed.

They establish an obligation of two weekly masses and other annual masses in the chapel of Cinco Chagas de Nosso Senhor Jesus Cristo of the monastery of Santíssima Trindade, where they wish to be buried, to which they entail their houses in Lisboa. All the administrators of the entail must also succeed on the administration of the chapel established by Catarina Vaz, wife of Paio Lourenço, in the church of São Nicolau of Santarém, which they currently administered.

Entail foundation deed by which Manuel Álvares de Castro and Francisca Carlos, his wife, establish and entail with the third part of their assets, which comprises houses in Lisboa, inns (estalagens) in Moita, Alhos Vedros, and Alvito, lands in Alvito ("herdade do Pinheiro"), rents (foros) in Azambuja and Carcavelos, a farmstead (quinta) in Arrentela and properties in Cabo Verde ("fazenda de Santa Cruz"). They appoint Nuno Dias de Castro, their son, to be its first administrator, obligating him and his descendants to support the celebration of a daily mass in the chapel of S. Catarina and Almas do Purgatório of the church of S. Nicolau of that city. He is allowed to choose which son should become the entail's second administrator. Afterwards it would be inherited by the eldest son of his successor.

He designated his son, André Caldeira, to administrate it. By doing so, he fulfilled a dowry deed which he and his late wife, Guiomar Caldeira, had issued, before the marriage of their son with Catarina da Silva, daughter of Lopo Furtado de Mendonça. The institutor determined that the perpetual pious obligations would only be declared in a chapel foundation deed. André Caldeira and Catarina da Silva, his wife, gave their consent to this deed.

Isabel de Góis renounces to her properties, only reserving an annual income during her lifetime, immediately giving the entail's ownership to her brother, who was present and accepted this entail, with its all declared conditions, declarations and obligations. The institutor also appoints João Mendes de Meneses as her successor in the available portion of D. Entail foundation deed by Cristóvão de Brito, member of the king's council. Cristóvão justifies the institution of the "morgado" as a way to prevent the scattering of the estates and to preserve his memory, allowing for better service to God and the kingdom and greater honour to the noble houses. The instituor decided to entail interest in the "alfândega" of Lisbon, his houses in Lisbon, located in the parish of S. Lourenço, and a farmstead in Ribatejo, leaving instructions for the acquisition of other properties to be included in the entail. The income from the properties would also support two daily and perpetual masses to be celebrated in the chapel of Nossa Senhora da Assunção, to be located in the church of the convent of Madre de Deus de Lisboa, which was under construction, and for which he had already purchased liturgical furnishings, such as a retable of "Nossa Senhora". The first administrator would be his nephew João de Brito, son of Lopo de Brito. An inventory of the assets was to be drawn up, with three copies: one for the administrator and the other two to be kept at the S. Elói Monastery in Lisbon and at the Hospital of Todos-os-Santos. His successors were also obliged to entail more property. The succession would pass through the first-born sons, excluding illegitimate children and clerics. The presumptive heir was not allowed to marry without the consent of his parents, under the penalty of being removed from the succession. In addition, each administrator had to be physically and mentally fit, to be loyal to the Church and to the Crown, and to use the name and the coat of arms of the Britos.

Entail foundation deed by Luís Álvares de Madureira, fidalgo da casa do rei, his wife and first-cousin Joana de Madureira, and his aunt Isabel de Madureira. Together they decided to establish an entail, using their farmstead of Freixo, in Guilhabreu, as the head of the entail. They decided to create the entail in order to avoid the division of the estates and the dilution of the memory of the lineage, arguing that the concentration of the inheritance in one institution, managed by the first-born, was also a way of supporting the other relatives. At that time, the couple had no children and decided that in the absence of descendants, the surviving member of the couple had the power to appoint the successor. However, the administrator of the entail should primarly be the first-born son, excluding clerics and those who commited lese-majeste crimes. The administrators were also required to entail other lands and to use the Madureira name and coat of arms. An inventory of the entail was to be made, with three copies: one to be kept by the administrator, and the others to be kept in the Municipality of Porto and in the Cathedral.

Entail foundation deed by Lopo de Barros, fidalgo da casa do rei, and Beatriz Bravo, acting as a refoundation act of the entail established by Martinho Mendes de Barros. This entail was also made up of several properties in Braga, to which the couple decided to add their farmstead of Real, which they had inherited from Diogo Bravo, Beatriz's father. Its religious duties, with masses for the soul of Martinho and also for Kings Afonso V, João II and Manuel I, were carried out in the chapel of Nossa Senhora do Rosário, located in the cloister of Braga Cathedral, where the tombs were located and which Lopo and Beatriz had rebuilt. The "morgado", united with the previous entail, was created to ensure the preservation and memory of their lineage and to better serve the Kings of Portugal. Their son Diogo de Barros would become the next administrator, followed by his first-born son. Administrators were also obliged to use the family name.

It was up to him to appoint the next administrator, who must be a male, of the generation of one of them. After the death of this first administrator, the successor was to be his eldest male son. After the death of Maria the succession should always continue, preferably, on the eldest male heir. However, if she had no children, then the administration should be handled to her sister Isabel Mouzinho or her brother Manuel Mouzinho de Albuquerque, or the descendants of her uncle António Mouzinho Barba. If the bloodline of all the appointed administrators was extinguished, then it should be handled to the descendants of Ana Vaz Mendonça, and if she also had no children, then the Confraria do Santíssimo Sacramento should receive the administration.

She named her nephew Miguel Dias da Nova as first administrator of the chapel with the condition that he would live on the houses she entailed in Alpalhão. After the death of Miguel Dias da Nova, he would be succeeded by her nephew Miguel Dias and after his death by Brás Calado, also her nephew. After the death of Brás, the succession should always continue on the eldest closest relative of the institutor, with the condition that he or she should be a talented person, capable of administrating the chapel. She ordered the administrators to keep two separate books, one for the record of this will and all of the entailed properties and the other for the record of the masses.
