Tenure contract of houses in Rua do Ferragial, in Lisboa, which belong to Isabel Dias' chapel. Miguel Rodrigues Ferreira, on the behalf of João de Andrade de Albuquerque, administrator of his grandmother’s chapel, gives these houses in perpetual lease to priest Luís da Cruz de Castilho, who will pay 6000 réis of annual rent to the administrator, as well as 860 réis to the convent of Nossa Senhora do Carmo de Lisboa for the accomplishment of the masses established by Isabel Dias. All the clauses are detailed. It inserts a royal licence by which the king authorizes this contract because the houses were in a very poor state (dated 1686-10-05). It also inserts a letter-of-attorney by which João de Andrade de Albuquerque authorises Miguel Rodrigues Ferreira to represent him in this tenure contract, referring that he succeeded his late brother Domingos Francisco de Andrade de Albuquerque in this administration (dated 1685-07-27).

Sale, quittance, and obligation deed by which the priests of the convent of S. Bento de Xabregas sell to D. Francisco de Almeida, fidalgo da Casa do Rei and comendador da Ordem de Cristo, widower of D. Ângela de Melo, and to his heirs and successors, the chapel of Santo Espinho of their church, to use as his family's burial place. He promises to ornament the chapel and to give a public debt instrument for the fulfilment of a daily mass for his and his relatives' souls. The priests accept and promise to fulfil the obligations and to never take the chapel's relics from their place.

Sale and bond deed by which D. João Luís de Vasconcelos and D. Maria de Noronha, his wife, represented by Gaspar Pinheiro, employed the third part of Maria da Maia de Lemos' assets, 37 000 réis, to buy a rent (foro) of 1 850 réis in a vineyard in Corredoura, Arruda dos Vinhos, which would be entailed to the chapel established by the deceased. D. Maria de Noronha was the daughter of one of the executors of Maria da Maia de Lemos' will, Fernando Álvares Cabral, the testator's son-in-law. Since Fernando died without fulfilling his obligations, the Provedor dos Resíduos forced his heirs to do it. Contains a copy of a letter of attorney issued on 1628-11-19 and a certificate concerning the validity of the signatures issued on 1629-01-29.

Resignation and appointment deed made by Inês da Mota, stating that Ermígio Fernandes had established a chapel in the mother church of Lagos, linking certain assets to fulfill the charges, appointing his eldest son to administer it. She also declares that the chapel was managed by Bento Gonçalves, her grandfather, and later by Gonçalo Martins, her father, from whom she had inherited it because she was the eldest daughter and had no brothers. Since she had no children, fulfilling the institution, the chapel should remain with her closest relative, namely Afonso de Almeida, her nephew, grandson of Gonçalo Martins and great-grandson of Bento Gonçalves.
It is inserted in an exemplification (dated 1545-03-02), inserted in a certificate.

Resignation and appointment deed by which Catarina Fernandes, Gomes Eanes' widow, appoints Pedro Gonçalves, husband of Catarina Eanes, her criada, to be the administrator of the entail she and her husband had established trough their will. In that document, issued on 1480-05-22, they both had declared that after the death of one of them, the surviving member of the couple should inherit lands and houses in Santa Iria da Azóia with the obligation of supporting the celebration of 10 annual masses in the church of that place. The entail's first administrator was obligated to appoint a successor.

Petition by which Bartolomeu Marchione and Gil Correia, executors of Pedro Paulo Marchione's will, ask the Juiz ordinário de Almada to validate it. They declare that due to the fact that Pedro was extremely ill, he was unable to make a complete will chart. Thus, he stated what were his final wishes, in front of 9 witnesses, asking Bartolomeu and Gil to take note of it. Pedro ordered that the third part of his assets should be delivered to his daughter, Ana Arrais de Mendonça, obligating her and her successors to celebrate masses for his soul in the chapel of Jesus of the convent of S. Domingos of Lisboa, where his body should be buried. Followed by an undated dispatch issued by Francisco Caldeira Freire.

DOCUMENTO/DATA DE INSTITUIÇÃO: contrato de partilhas (II vol., f. 9-24) feito em 1522-06-12 por António de Almeida, notário público por el-rei na cidade do Funchal e sua capitania; o contrato de partilha contém o traslado da outorga do alvará régio de Manuel, para suprimento da idade do filho Cristóvão Esmeraldo. Contrato retificado no testamento e codicilo (II vol., f. 2-9) do instituidor João Esmeraldo "o Velho", aprovados em 1536-05-27, pelo notário do lugar da Ribeira Brava, Sebastião Álvares; aberto em 1536-06-19.
MOTIVOS DA FUNDAÇÃO: no contrato de partilhas esclarece-se que não tinham outros filhos e por isso queriam em sua vida dar partilha dos bens de raiz que possuíam. No testamento, o testador encontrava-se mal disposto de doença, mas de pé.

ENCARGOS (ANUAIS):
1) MORGADIO DO SANTO ESPÍRITO: missa quotidiana por alma dos fundadores, na ermida do Santo Espírito, dita por um capelão pago pelo seu preço, com a cera e azeite necessários, e a obrigação de reparar e ornamentar o dito templo.
Uma quitação dos párocos António Paes e Francisco Rodrigues, datada de 1635-04-16 (I vol., fl. 113/113 v.º), alude ao ornato da capela e ao aparato da festa do Santo Espírito sob a administração de Francisco Gonçalves da Câmara: afirmam que no tempo em que foram capelães do dito senhor, este dotou o templo de retábulos, frontais, vestimentas, lampadário e castiçais de prata; acrescentam que no dia da festa havia canto de órgão e instrumentos musicais, bem como vinham padres da Companhia, frades de São Francisco ou outros, para pregar e ali permaneciam vários dias.
REDUÇÃO DE ENCARGOS: uns embargos interpostos em 1635 (I vol., f. 91 e seg.) pela administradora D. Isabel Esmeraldo, contestam que no tempo do bispo D. Luís de Figueiredo a pensão de um anal de missas foi reduzida a oito meses, facto provado por inúmeras quitações. Porém, a sentença de 1635-08-11 (I vol., fl. 128) não lhe é favorável, mantendo-se a obrigação inicial. A informação do procurador do Resíduo (II vol., f. 36 v.º), esclarece que, pela redução de 1814-03-20, esta capela ficou anexa à capelania da Lombada e com pensão de vinte missas anuais.
Em 1819-01-28, indulto apostólico de componenda de pensões caídas, obtido pelo administrador João de Carvalhal Esmeraldo.

Os fundadores criam outro vínculo, do Vale da Bica, para o filho João:
2) MORGADIO DO VALE DA BICA: missa cantada anual na igreja de São Pedro, no seu dia, com cera e o mais necessário, e uma missa rezada semanal pela alma dos instituidores.
REDUÇÃO DE ENCARGOS: A sentença de 1819-09-17 (III vol., fl. 41) reduz todas as capelas administradas por D. Maria de Ornelas, tutora do filho Aires de Ornelas Vasconcelos (então herdeiro do morgadio do Vale da Bica), à pensão anual de 70.000 réis pagos à Misericórdia do Funchal.

SUCESSÃO DOS MORGADIOS: nomeia os filhos João Esmeraldo (filho do instituidor e da falecida mulher D. Joana Gonçalves da Câmara) e Cristóvão Esmeraldo, sucedendo pessoa da sua geração, a saber, filho primogénito se houvesse, não havendo passaria a outra pessoa mais chegada à geração dos fundadores.
BENS VINCULADOS: morgadios do Santo Espírito e do Vale da Bica, Ponta do Sol, resultantes da divisão da Lombada de João Esmeraldo em dois grandes “lotes”, como determinado no aludido contrato de partilhas (vol. II, f. 9/24 v.º). No testamento, declara-se que a Lombada está aforada em fateusim, com a pensão de 150.000 réis anuais. O contrato de partilhas descreve os bens de raiz do casal: i) Lombada da Ponta do Sol, do mar à serra, constituída por terras de canaviais, de pão e montados, com suas águas, assentamentos, engenhos, casa de purgar, pomar, a qual lombada parte de um lado com a ribeira da Ponta do Sol, e do outro pela ribeira da Caixa; ii) assentamento de engenho e casas de purgar, chãos e outras benfeitorias sita além da ribeira da Ponta do Sol; iii) fazenda sita além da vila da Ponta do Sol, aforada a D. João Henriques por 100.000 réis ao ano; iv) um grande assentamento de casas na rua que sai do varadouro dos batéis para cima e passa à outra rua do Sabão; v) três casas terreiras frente a este assentamento de casas.
Os mencionados embargos de 1635 (I vol., f. 111) referem que, ao tempo da instituição, o morgadio do Santo Espírito produzia nove mil arrobas de açúcar por ano e que agora (1635) não chegavam a sessenta, e para isso era necessário sustentar um engenho com seus pertences e fábrica.
A verba declaratória (III vol., f. 49), datada de 1851-10-22, refere que que se encontra sub-rogado o capital do foro das terras do Jangão, Ponta do Sol (morgadio do Vale da Bica) pelo capital do foro de terras da quinta do Palheiro Ferreiro, pertencentes à quinta do Garajau.

DOCUMENTO/DATA DE INSTITUIÇÃO: contrato de partilhas (f. 161 v.º-176) feito em 1522-06-12 por António de Almeida, notário público por el-rei na cidade do Funchal e sua capitania; o contrato de partilha contém o traslado da outorga do alvará régio de D. Manuel, para suprimento da idade do filho Cristóvão Esmeraldo. Contrato retificado no testamento e codicilo (II vol., f. 2-9) do instituidor João Esmeraldo "o Velho", aprovados em 1536-05-27, pelo notário do lugar da Ribeira Brava, Sebastião Álvares; aberto em 1536-06-19 (f. 155-161 v.º). Traslados de 1796-07-07.
MOTIVOS DA FUNDAÇÃO: no contrato de partilhas esclarece-se que não tinham outros filhos e por isso queriam em sua vida dar partilha dos bens de raiz que possuíam. No testamento, o testador encontrava-se mal disposto de doença, mas de pé.

ENCARGOS (ANUAIS):
1) MORGADIO DO VALE DA BICA: missa cantada anual na capela de São Pedro (quitações posteriores identificam como a capela de Santo Amaro, Ponta do Sol), no seu dia, com cera e o mais necessário, e uma missa rezada semanal pela alma dos instituidores.
REDUÇÃO DE ENCARGOS: a sentença de 1819-09-17 (Cx. 106-9, III vol., fl. 41) reduz todas as capelas administradas por D. Maria de Ornelas, tutora do filho Aires de Ornelas Vasconcelos (então herdeiro do morgadio do Vale da Bica), à pensão anual de 70.000 réis pagos à Misericórdia do Funchal.

Os fundadores criam outro vínculo, do Santo Espírito, para o filho Cristóvão:
2) MORGADIO DO SANTO ESPÍRITO (processo na Cx. 106-9): missa quotidiana por alma dos fundadores, na ermida do Santo Espírito, dita por um capelão pago pelo seu preço, com a cera e azeite necessários, e a obrigação de reparar e ornamentar o dito templo. Últimos administradores: casa do Conde de Carvalhal.

SUCESSÃO DOS MORGADIOS: nomeia os filhos João Esmeraldo (filho do instituidor e da falecida mulher D. Joana Gonçalves da Câmara) e Cristóvão Esmeraldo, sucedendo pessoa da sua geração, a saber, filho primogénito se houvesse, não havendo passaria a outra pessoa mais chegada à geração dos fundadores.
BENS VINCULADOS: morgadios do Santo Espírito e do Vale da Bica, Ponta do Sol, resultantes da divisão da Lombada de João Esmeraldo em dois grandes “lotes”, como determinado no aludido contrato de partilhas (vol. II, f. 9/24 v.º). No testamento, declara-se que a Lombada está aforada em fateusim, com a pensão de 150.000 réis anuais. O contrato de partilhas descreve os bens de raiz do casal: i) Lombada da Ponta do Sol, do mar à serra, constituída por terras de canaviais, de pão e montados, com suas águas, assentamentos, engenhos, casa de purgar, pomar, a qual lombada parte de um lado com a ribeira da Ponta do Sol, e do outro pela ribeira da Caixa; ii) assentamento de engenho e casas de purgar, chãos e outras benfeitorias sita além da ribeira da Ponta do Sol; iii) fazenda sita além da vila da Ponta do Sol, aforada a D. João Henriques por 100.000 réis ao ano; iv) um grande assentamento de casas na rua que sai do varadouro dos batéis para cima e passa à outra rua do Sabão; v) três casas terreiras frente a este assentamento de casas.
SUB-ROGAÇÃO DE BENS: a verba declaratória (Cx. 106-9, III vol., f. 49), datada de 1851-10-22, refere que que se encontra sub-rogado o capital do foro das terras do Jangão, Ponta do Sol (morgadio do Vale da Bica) pelo capital do foro de terras da quinta do Palheiro Ferreiro, pertencentes à quinta do Garajau.
ADMINISTRADOR (do morgadio do Vale da Bica, presentes autos) em 1649-09-20, data da primeira quitação (f. 2): António de Carvalhal Esmeraldo, que presta quitações de missas ditas na sua capela de São Pedro do morgado da Lombada. Em 1669-08-2[…] presta contas D. Luzia de Moura, como tutora do filho morgado. Em 1673 (f. 38) é administrador o capitão António de Carvalhal Esmeraldo. Em 1699-10-17 (f. 58) presta contas Aires de Ornelas e Vasconcelos. Em 1796 administra o morgado Agostinho João de Ornelas e Vasconcelos.

Libel of accusation presented by Cristóvão Freire de Andrade and D. Paula, his wife, plaintiffs, against Luís de Vilalobos de Vasconcelos and Teodósia do Vale, his wife, defendants, stating that Martinho Vicente de Vasconcelos had established an entail, in his will, with income from the Fonte Boa's farm (herdade) and the Valbom's vineyards. The plaintiffs accuse the defendants of, after the death of Nicolau de Vilalobos, previous administrator, descendant of the institutor and father of the plaintiff and defendant, the defendant usurped the administration of the chapel, not leaving it after five years, as expected in the institution. They ask for the conviction of the defendants, who should lose the administration.

Libel of accusation presented in a civil process between João Luís and Domingas Lopes, plaintiffs, against Francisco Luís and Violante Afonso, defendants, containing the charges of the institution.
Francisco Luís, as attorney of João Luís, his nephew, had received a favorable sentence in a deed filed against Paulo de Reboredo, who brought the administration of the chapel. However, falsifying the information, he had said that he was the oldest son of Luís Eanes, although he was not. The sentence was, therefore, passed in his name and did not give João Luís, his nephew, son of João Luís, eldest son of Luís Eanes, who had been the administrator of that chapel.

Followed by a copy of an extract of a letter, written in 1668, in which Fernando Pires de Sousa expresses his wish to establish a chapel in the church of S. Julião of Lisboa, where he was baptized, to which he wanted to entail a public debt instrument of 40 000 réis. He declares that his nephew, Pedro de Sousa, should be its first administrator, to whom would succeed his other nephew, Manuel Guterres. He orders the latter to make an agreement with the priests of that church.

The entail also had the obligation of a monthly mass in a chapel to be built in that estate, or in the chapel of Santa Luzia in Braga's cathedral.
